Avishai is the Director of Advisory Services at PrivacyTeam, a leading global DPO and privacy consultancy. He holds degrees in Law & Government, Diplomacy and Strategy from the Interdisciplinary Center in Herzliya, as well as several professional certifications from the IAPP. What Are The Key Requirements in the Digital Personal Data Protection (DPDP) Bill of India? Let us understand these with Punit Bhatia in The FIT4Privacy Podcast E099


In summary, these requirements include grounds for processing personal data, contracts with data processors, security of personal data, data breach notifications, personal data retention, contact for concerns and complaints, rights and duties of data principles, significant data fiduciaries, processing of personal data outside India, exemptions, the Data Protection Board of India, and penalties. The law is heavily reliant on consent, and there are additional requirements for significant data fiduciaries such as appointing a Data Protection Officer and conducting periodic Data Protection Impact Assessments. It also allows for exemptions for outsourcing contracts and provides companies with the opportunity to appeal to a tribunal before going to the judicial system. Penalties can be up to 250 crore rupees (approximately 31 million US dollars).

Key Definitions in India's Digital Personal Data Protection Bill are Explained in this episode. India recently passed its Digital Personal Data Protection Bill, and in this episode, twelve key definitions from the bill are discussed.

These include data principle (similar to EU GDPR's data subject), child (defined as anyone below 18 years of age), data fiduciary (similar to EU GDPR's data controller), data processor (same as EU GDPR), person (individuals, companies, etc.), data protection officer (only required for significant data fiduciaries), personal data (similar to EU GDPR), personal data breach (similar to EU GDPR), processing (any operation performed on personal data), public interest (elements/activities that lead to security and other threats), consent manager (a new term for intermediaries or third parties/brokers) and digital office (a privacy office).

Dr. W Kuan Hon is Of Counsel in the Privacy and Cybersecurity Group of leading international law firm Dentons. An English solicitor and New York attorney with degrees in computing science as well as law, Kuan advises not only on data- and security-related laws but also on broader tech law issues, particularly regarding cloud and AI. She is a member of the UK government's International Data Transfer Expert Council, an Editor of the Encyclopedia of Data Protection and Privacy, and a guest lecturer for the Department of Computing at Imperial College London. Kuan previously volunteered for the UK Information Commissioner's Office, the UK National Cyber Security Centre, and the UN Privacy Preserving Techniques Legal Task Team. She is the author of "Data localization laws and policy - the EU data protection international transfers restriction through a cloud computing lens" (Edward Elgar, 2017) and has contributed to other books and written numerous articles.

Later on, back in 2008, Peter started as a security advisor in healthcare.

In 2012, Peter started as a self-employed trainer and consultant just after the publication of the first GDPR text. His training company, the Data Protection Institute, started that year with DPO certificate training. In these years, Peter explored the role of a DPO, mostly in health care. With his consulting company, White Wire, he offered data protection services for hospitals and other care centers. White Wire is now part of Cranium.

Enable it, then you can move forward with your ideas of achieving the best possible outcome. You need to have service orientated mindset when implementing data protection. As a legislator, I am not trying to reduce your potential. We should be there in aiding businesses and professional practitioners in creating and providing the relevant framework. And, please make sure that you are not overstepping the rights of others. But it's all a matter of mindset and using the potential of what is already there to be more successful as a result.

Dr. Ann Cavoukian is recognized as one of the world’s leading privacy experts. Dr. Cavoukian served an unprecedented three terms as the Information & Privacy Commissioner of Ontario, Canada. There she created Privacy by Design, a framework that seeks to proactively embed privacy into the design specifications of information technologies, networked infrastructure, and business practices, thereby achieving the strongest protection possible. In 2010, International Privacy Regulators unanimously passed a Resolution recognizing Privacy by Design as an International Standard. Since then, PbD has been translated into 40 languages! In 2018, PbD was included in a sweeping new law in the EU: the General Data Protection Regulation.  Dr. Cavoukian is now the Executive Director of the Global Privacy & Security by Design Centre. She is also a Senior Fellow of the Ted Rogers Leadership Centre at Ryerson University, and a Faculty Fellow of the Center for Law, Science & Innovation at the Sandra Day O’Connor College of Law at Arizona State University.   Dr. Cavoukian is the author of two books, “The Privacy Payoff: How Successful Businesses Build Customer Trust” with Tyler Hamilton, and “Who Knows: Safeguarding Your Privacy in a Networked World” with Don Tapscott. He then talks about big tech having all the data and how it is too late to protect it. However, he is optimistic and believes Europeans should invest more money in research and come up with alternative solutions that are compliant with the GDPR. Lastly, he talks about AI and chat GPT, explaining how it can be used for good, but also how it could lead to people abusing it if a framework is not created for its correct usage. Federico Marengo is senior data protection consultant at White Label Consultancy and he previously worked for other data protection consulting companies supporting the implementation of privacy programs in organisations and as an external DPO.  

  

He is a lawyer, master in public administration (University of Buenos Aires), LLM (University of Manchester), and PhD (Università Bocconi, Milano). He is specialised in the legal and privacy challenges that AI poses to the rights of data subjects and how companies can comply with data protection regulations and use AI systems responsibly. This is also the topic of his PhD thesis. He is the author of “Data Protection Law in Charts. Meet Ganesh Krishnan, a cybersecurity superhero with over 25 years of experience protecting the digital world from cyber threats. As a two-time founder with a track record of success at some of the world's top tech companies, he's earned a reputation as a thought leader at the forefront of cybersecurity. Now at the helm of Anzenna, his latest security startup, he's out to revolutionize the industry by making cybersecurity accessible to every employee, not just the security team. 

 

Ganesh first realized his passion for digital security in college, working in the Purdue University cybersecurity lab. After earning his master's in Computer Science in 1997, he immediately got to work in the industry. Over the next two decades he worked his way to top-level security and engineering roles at companies like Yahoo!, LinkedIn, and Atlassian, as well landing a spot on the Forbes Technology Council.
