I have litigated many employment lawsuits over the years and can typically pin point the reason why the employee decided to sue the employer, rather than just moving on. Here are the top reasons why:

1. The employee was terminated but wasn't aware he was doing a bad job at work.
2.  Employee didn't know why he was fired
3.  Employer gave a negative reference to the new prospective employer
4. Other people did the same things and got away with it
5. Toxic managers
6.  The employee was forced to quit because of the toxic environment
7. Things changed after they complained to HR.

Artificial Intelligence can be used to streamline the various processes used in the recruiting and hiring process. There are many benefits including a reduction of time for all parties involved, as well as a decrease in expense, greater efficiency and overall standardization of the hiring process. However, there is a concern that the information inputted into the system may have the opposite of the intended effect, and rather than standardize the process, may overly limit or even disqualify members of a protected class. This creates potential liability and risk for the employer.

The National Labor Relations Board issued a decision on McLaren Macomb and Local 40 RN Staff Council, on February 21, 2023 concluding that severance agreements may be deemed unlawful if they broadly restrict an employee’s ability to speak about the agreement or disparage their employer. 

In this episode, Karly Wannos discusses  the NLRB decision, and whether businesses may need to reconsider the confidentiality and non-disparagement clauses in severance agreements.

The Pregnant Workers Fairness Act (PWFA) is a new law that requires covered employers to provide “reasonable accommodations” to a worker’s known limitations related to pregnancy, childbirth, or related medical conditions, unless the accommodation will cause the employer an “undue hardship.”

Reasonable accommodations” are changes to the work environment or the way things are usually done at work.

The House Committee on Education and Labor Report on the PWFA provides several examples of possible reasonable accommodations including the ability to sit or drink water; receive closer parking; have flexible hours; receive appropriately sized uniforms and safety apparel; receive additional break time to use the bathroom, eat, and rest; take leave or time off to recover from childbirth; and be excused from strenuous activities and/or activities that involve exposure to compounds not safe for pregnancy. Employers are required to provide reasonable accommodations unless they would cause an “undue hardship” on the employer’s operations. An “undue hardship” is significant difficulty or expense for the employer. 

The PWFA goes into effect on June 27, 2023.

Here is a very common scenario: Your company conducts an annual or monthly performance evaluation.  There is one employee who believes you are “targeting” him or picking on him or holding him to a higher standard because of a protected class.

Despite the employers best efforts to implement a fair evaluation system and ensure that managers apply performance standards consistently, employees may complain that their evaluations were unfair or inaccurate for discriminatory reasons.

Using hashtags so your audience can find you. 

Create a Bio and Headline that stands out so your audience wants to connect with you.

Build credibility through interviews and repurpose your content.

Diversify your content but also focus on your niche.

10 Aug 2021012: Post-Pandemic Tax Implications of Remote Employees - with Jamie Szal, Esq.00:33:07

Who knew you could have so much fun taking about tax and remote employees?  Tax attorney, Jamie Szal explains the various tax implications for employers with remote employees during and after the pandemic. During the pandemic, states treated business with remote employees differently for tax purposes. For example, some states took a hard line approach and announced the pandemic-necessitated remote working created nexus for the employer for all purposes, while some states announced they would not enforce nexus against out of state companies by virtue of the pandemic-related in-state presence of telecommuting employees.

If your business has employees working outside of the state in which the company does business, it is important to determine what state the employee is actually working in, as there may be additional tax considerations. Some states have allowed a waiver period, and some did not. Some states have allowed a transition period, and some have not.  In addition to identifying where the businesses employees were located during the pandemic, businesses should also take proactive steps to determine if it will allow its employees to continue working remotely going forward relative to tax and other compliance issues.

TAKEAWAYS
Now is the time to engage in strategic planning business considerations. Businesses who have not already don't so need to determine:

1. Where the employees have actually been working throughout the pandemic.
2. Will the business continue to allow a remote or hybrid workforce.

27 Jan 2022021: What to Include in an Offer Letter00:13:56

After the interview, the offer letter is potentially the next major interaction a prospective employee may have with your business. Offer letters are important for legal purposes and to prevent litigation. Many states have at-will employment, so there may not necessarily be a contract at the time of hire. However, for at will employment states, there should be an offer letter. 

In this podcast episode, we are discussing the dos and don’ts of offer letters. I discuss what should be included, and what you should not include. For example, include specifics like start date, rate of pay (include hourly or annual salary) and when bonus or commission will be paid. You will also want to include that the employment is at will. A few things you want to keep out are verbiage that mentions the duration of the job or what constitutes grounds for termination, as this may inadvertently create a contract in an otherwise at will state.

The onboarding process is very important for several reasons. First, it’s one of the first impressions the company will make on the new hire. 

The systems, processes, how he/she is introduced to the day to day of what he/she will be doing. If the first impression is chaos, confusion, overwhelm, this is how the employee will perceive that the entire company is run. In comparison, if the employee is met with a warm welcome, properly intrude to the processes and systems, and has a chance to experience the culture, he/she will feel better about the decision to join the company. In the long run, this will serve to Limit overwhelm and reinforce the clear expectations and improved retention rates.

In this episode, we will discuss termination of employees. Employees my be hired with the best intentions for the work relationship to work out. However, sometimes the relationship breaks down, and the employer and employee need to part ways. If the employer determines it must fire an employee, can it give a vague reason, such as "its not working out" or does the employer need to give the reason for the termination?  HINT: The answer to this question, and my recommendations for best practices (in certain situations) are different.
