As lawyers, we want to understand if there are any inconsistencies or if they've left out any important information to help find the truth behind your motor vehicle injury case. The first thing we would do is to see whether or not there are any witnesses listed in the police report. We will try to get the witnesses' information so that we can get a statement from them. If there are competing stories to the accident, a witness statement is very helpful in terms of trying to resolve issues of liability and how it occurred. What other evidence did the police collect? Did they look at the vehicle? Did they see if there were any rub marks on it or any transfers? Was the car dirty? Did our client take photographs or anybody take photographs at the scene of the accident? Because sometimes you'll find some information there. Was the injury consistent with a trip and fall? For us, we looked at the injury itself to see if it is consistent with a trip and fall? Having it looked at by a biomechanical engineer, who is an engineer that studies how forces act on the body. We are usually able to determine if it’s possible to get that kind of fracture from just simply tripping and falling or if the injury was the result of a motor vehicle accident. Notify the Business or Store Manager Following a slip and fall incident the first thing that you should do is to notify the store or the store manager so that an incident report is recorded. Make sure your accident is recorded and it is documented that you were physically in the store. This will be essential if you need to take your claim to court and the insurance company requires proof that the slip and fall did in fact occur. 2. Take photographs of your surroundings and area you slipped and fell on Another very important thing to note is to remember to take pictures of the area that you slipped and fell on. Evidence of your surroundings will be helpful in your claim so it is important to document and take photographs of the floor, stair, uneven pavement, etc. Remember to pay attention to what’s on the floor whether it be liquid or ice build up that was the cause of your slip and fall. This will be crucial if you need to back up your claim with evidence long after the accident’s occurrence. 3. Identify witnesses and take down contact information If there are witnesses, ask for the witness' names and contact details so that your lawyer can call them for a witness statement. If the accident occurred inside a premises such as a mall or a retail store, the parties that are involved might be different. Why it’s important to report your slip and fall incident ASAP There is a specific time period that we have to provide notice to the potential defendants in the slip and fall case. It’s important to note that on slip and fall/ trip and fall cases in particular, time is critically important and very short as compared to some other injury type claims. Property owners need to be given notice very shortly after so it is important to document your accident in an incident report immediately. These laws include the deductible, which requires the judge to reduce the jury's award of damages outside of the presence of the jury; the cap, which limits the amount of money people in Ontario can recover for pain and suffering; and the threshold, which allows the insurance company to ask the judge to second-guess the jury's decision to award compensation to an injured party. These laws are stacked against the victim of the injured party to drive down the value of the case and make it difficult for them to receive fair compensation. First Party Claims- No Fault Side of Benefits. No fault side of the benefits entitled you to certain medical rehabilitation benefits and income replacement benefits. And all of those rights also remain the same even if you are found to be at fault or if you're not at fault as well. So those are available to everyone, with few exceptions, irrespective of how the accident happened. Ordinarily if an at fault driver was identified. You would have a claim against them, and that would be defended and paid for by their insurance company. UIM- Underinsured or Uninsured Motorist Coverage. Now if that car flees the scene and is never found. The good news is you could still, in many instances, have a claim against insurance. And that's a really unique coverage referred to as UIM- Underinsured or uninsured motorist coverage. In a UIM coverage situation, your own insurance company would act as the at fault party's insurance company and therefore you would seek damages and compensation through your own insurance company instead. Hit and Run Accidents Involving Cyclist or Pedestrian. Even if it's a cyclist or a pedestrian, their own insurance company, their own auto insurance company would still cover them. The no fault insurance that we talked about earlier. As well as if the other driver fled the scene. Their own insurance company would also step in as a UIM carrier or in underinsured or uninsured motorist insurance policy. There are many different types of benefits and coverage available to you as a victim of a hit and run accident. And how that creates a challenge to the claim and sort of some of our strategies to overcome those challenges. If clients have pre existing injuries, more often than not, the insurance company would try to use that to their advantage and basically try to pin all the new injuries saying that it was from the preexisting injuries, our clients pre existing injuries. So it's very important to let your doctor know how the injuries have been exacerbated, or how they're different from your pre existing injuries. It's important for clients to know they need to be forthcoming because sometimes people might wanna hold back information when they're talking to a lawyer and they're kind of downplaying their pre-existing because they're afraid people are gonna judge them by that and try to attribute everything to that. Be open and honest about previous injuries and pre-existing conditions. Be as candid as possible. It's better for your lawyer to know what you’re dealing with so they can come up with strategies to best address it. What kind of things do you see the insurance company doing when they see preexisting health? Generally speaking, whenever insurance companies see that potential clients have preexisting health conditions, they basically try to pin all their current symptoms since the accident on the preexisting health conditions. And again, that's why it's so important to let your doctors know how they differ from your previous injuries. To further the claim, we would obtain statements from family members, coworkers and friends, to speak about how you were functioning before the accident, as opposed to after the accident. This is so that you can show how the accident impacted your life. In terms of compensation, the insurance companies are only gonna pay for how it affected your life and how it affected your medical condition. What's the difference between the crumbling skull and the thin skull theory? That's a term that lawyers use. The thin skull theory is a theory in law. It's a rule of law basically that says that if somebody causes harm to another person, they're responsible for the outcome irrespective of the fact that that person may have been more vulnerable. Conversely, the insurance company and their lawyers will try to paint the picture using a different theory of law, which is called crumbling skull. Crumbling skull theory says that this person was deteriorating with time and the injuries were bound to happen eventually. The best way to defeat that is obviously with medical evidence. So you need doctors, you need specialists, you need experts that can give those kinds of opinions. But then you have to also get behind that, bring it to life, beyond just the black and white and the medical records. With the observations of the people that know this person best. And that can be really, really persuasive in these types of cases. So that could be a situation where someone has suffered a severe brain injury and is unable to make decisions on their own. Another example would be if somebody's legally considered a person under disability, for instance, a minor that can't make legal decisions on their own. What Is A Substitute Decision Maker? If an individual is disabled in an accident and has sustained very traumatic injuries that renders them unable to make decisions on their own. A Substitute decision maker, usually their next of kin such as the wife or husband would step in and be listed as their guardian. and advise us that their loved one was involved in a very serious motor vehicle accident for example. More likely than not, they're gonna be listed as their guardian. As a substitute decision maker they could make not only all the legal decisions but also financial decisions such as opening or closing bank accounts and authorizing payments. What Is A Litigation Guardian? The litigation guardian also makes decisions on behalf of the plaintiff who's disabled or a minor. A Litigation Guardian has effective control over the case brought on behalf of a person with a disability. As a lawyer, we would take instructions from the litigation guardian over matters such as any potential settlements and decisions that would benefit the plaintiff. What Is A Capacity Assessment? A capacity assessment is a tool used to evaluate if an adult is capable of making personal or financial decisions on their own behalf and understand the consequences of their decisions. A capacity assessor would run tests to see if the adult understands all the facts and considerations when making a decision. It is important to assess individuals who have suffered traumatic brain injuries to determine whether or not they require someone to step in to make personal decisions for them. What Are Structured Settlements? Typically what would happen in a settlement, if you settled your case for X dollars, you get a check for X dollars. In a structured settlement instead of paying you directly the money. The insurance company actually buys an annuity. The settlement is structured so that it pays out whatever form and amounts you've agreed upon. These can be very helpful in cases where someone needs lifelong healthcare and there are monthly expenses required. There would just be payouts monthly to cover those expenses so that the capital's preserved. With children that are injured, you can structure the settlements so that there are payouts when they reach the age of majority and payouts throughout their 20’s into their 30’s. So there's a lot of value to structured settlements and it’s a good way to preserve capital to protect the injured party. s. It's a good way to, like I said, preserve capital.
