The Briefcase is our shorter episode each week when we catch up on news and often share listener feedback. Today, we're covering a local fairness ordinance, the Oprah 2020 frenzy, and the public DACA meeting President Trump convened. In our first block, Sarah emotionally describes the difficulty inherent in holding public meetings to pass a fairness ordinance in the city of Paducah, KY. Paducah is Kentucky's 9th city to pass protections for LGBTQ+ individuals. In this segment, Beth mentions the work of Equality Ohio to support state-wide fairness legislation in Ohio. We then turn to the frenzied discussion of Oprah's presidential prospects -- which we believe misses the point of her speech entirely. In this discussion, we reference Susan Faludi's piece, The Patriachs Are Falling. The Patriarchy is Stronger Than Ever, and a conversation on Twitter resulting from listener M.E. sharing an article about soft skills in the tech industry. Unfortunately, we are unable to locate any nuance for the gentleman who is suing Google for discrimination. The Virginia House of Delegates seated a record number of women in January, and those women aren't messing around. We attended The Blue Victory Dinner in Arlington, Virginia and spoke to some of them about their successful campaigns and the importance of women in political leadership. The Delegates: Jennifer Carroll Foy, 2nd district: A public defender, Jennifer is a graduate of the third class of female cadets to ever attend the Virginia Military Institute. Wendy Gooditis, 10th district: An educator and local business operator, Wendy co-founded the Clarke County chapter of Indivisible following the November 2016 election. Kathy Tran, 42nd district: Kathy is the first Vietnamese-American to be elected to the General Assembly and a former federal government employee. She came to the United States as a refugee and has spent her career advocating for workers, working families, and immigrants. Hala Ayala, 51st district: A public servant and cyber security expert, Hala is one of the first Latinas to be elected to the General Assembly. A former vice president of the National Organization of Women (Virginia chapter), Hala has also served on former Governor McAuliffe's Council of Women and is an advocate for women and families. Karrie Delaney, 67th district: A long-time local civic leader, counselor for sexual assault survivors, and advocate against human trafficking, Karrie beat a four-term Republican incumbent with a campaign focused on economic growth & innovation, education and health care. Plus, we discuss Leah's feedback on our antitrust episode: On antitrust, your discussion of the very grey area was so important. I'm a policy lawyer in the agricultural industry, and consolidation and mergers are a huge topic for our industry like most. Obviously, there are concerns about putting market share into less and less companies, and I share those concerns. At the same time, the costs, for example, of bringing new seed or a new drug to market are prohibitive and possibly insurmountable for any new/small company to actually hurdle. So, along with this discussion of what the corporations are doing to limit market access, is a question of, has the government through regulation or other means also (unintentionally) encouraged that consolidation and lack of market access? I'm totally in support of reasonable regulation and I see the need for a lot of the reviews/permits/etc that have to be done for many of these companies that create high tech solutions like seeds, pharmaceuticals/etc. At the same time, if those requirements are making it impossible for new innovation to be explored (and if that new innovation is not going to be properly funded through public research-but that's another issue) than aren't we (collectively as the govt/people demanding this) at least contributing to the issue of the consolidation? We also appreciate our listener Sarah explaining that paper was indeed invented by a person at a specific time: Sarah, you made an off-hand comment in the latest episode about how no one really invented paper, and societies all simultaneously invented it. It was actually invented in China in 105 AD by Tsai Lun. Papyrus, because it is woven, is not technically paper, so it was definitely invented in China at one time (approximately). Hosted on Acast. Sadly, Caleb Sharpe, a 15-year-old sophomore entered his school in Rockford, Washington, with an assault rifle and a pistol. He killed one classmate and injured three others before Joe Bowen, a janitor and military veteran, heroically intervened. Sharpe, who had given indicators that he was a danger to himself, said he intended to teach a lesson on bullying. St. Louis. In 2011, Jason Stockley, a police officer at the time, killed Anthony Smith during a drug stop. Following a bench trial, a judge acquitted Stockley of first-degree murder. We discuss the facts and the fallout from this verdict in a city struggling with racial tension and economic angst. Graham-Cassidy. Republicans are scrambling to pass healthcare reform in advance of the September 30 fiscal year end in order to set the table for tax reform. Senators Lindsay Graham and Bill Cassidy have proposed a new version of "repeal and replace" that would turn over funding and control to states. This Washington Post article succinctly explains the differences between various healthcare reform efforts and the Affordable Care Act. We discuss the issues with this plan and urge listeners who oppose the plan to take it seriously. Compliment the Other Side. Beth compliments Senator Elizabeth Warren for working on legislation that would allow individuals to implement a credit freeze for free. First up, Trump and Kellyanne fight with Nordstrom. Trump earlier this week tweeted that "My daughter Ivanka has been treated so unfairly by @Nordstrom. She is a great person – always pushing me to do the right thing! Terrible!" (And it was retweeted by the official @POTUS account) Then, Kellyanne stated on Fox & Friends: "Go buy Ivanka's stuff, is what I would tell you," Conway said. "It's a wonderful line. I own some of it. I fully -- I'm going to just, I'm going to give a free commercial here: Go buy it today, everybody. You can find it online." The comments could run afoul of a federal law that bars public employees from making an "endorsement of any product, service or enterprise, or for the private gain of friends, relatives, or persons with whom the employee is affiliated in a nongovernmental capacity." James Nuzzo, a legal scholar and founder of the Colchester Group consulting firm, took a closer look at President Trump's tweet and noticed something very important was missing: Specifics. All the tweet accuses Nordstrom of "doing" is being "very unfair," Nuzzo points out. Any lawsuit the company brings against Mr. Trump would have almost no chance of success. Moreover, the U.S. Supreme Court has made it clear that only factual misrepresentation, in other words specific lies — not opinion — would be considered libel or slander. And the tweet almost seems to have been crafted very wisely with that precedent in mind. Someone saying another person or company is "unfair" is almost the definition of an opinion as "fairness" cannot really be defined legally or otherwise. In short, don't expect President Trump to get a slap on the wrist or any other kind of slap from the courts over this. Congress is a different matter. A much stronger argument could be made that Congress could officially censure President Trump for his conduct connected to the tweet against Nordstrom and several others like it that specifically attacked or demeaned businesses and individuals. Plus, we ask Just how much trouble is Michael Flynn in? and talk about North Korea conducts ballistic missile test. In the Suit, we talk about Washington v. Trump and do our best to summarize the decision.
