20 Sep 2019Five Things You Need to Know About Labor Unions00:23:39

Five Things You Need to Know About Labor Unions:

1. The American labor movement sprang to life with industrialization and resulted in many of the workplace protections we enjoy today. (02:02)

2. Union membership peaked in the mid-20th century but struggled with racist and sexist policies as well as corruption within the leadership and anti-union government policies. (11:10)

3. As private union membership began to decrease, public service unions began to grow. (17:57)

4. We are also seeing the rise of organized action beyond the public sector as well. (20:04)

5. There is also a rise of collective action inside tech about both worker issues and societal issues. (21:46)

14 Nov 2017Roy Moore, Trump's Asia Trip, and Tax Cuts01:02:52

You know things have gone terribly wrong when we're having a national conversation about whether a 14-year-old girl consented to a relationship with a man in his thirties. We discuss the responses to Roy Moore, the President's presence in Asia, and the process and substance of the Republican tax cut plan.

Thanks so much to everyone supporting our work on Patreon and to today's sponsors: ModCloth, The Flex Company, and VirtueLabs. We are scheduling speaking events for 2018. Please email Beth for more information.

We take a minute to extend our thoughts and prayers to everyone impacted by the terrible earthquake in Iran and Iraq

The Washington Post story on Roy Moore has prompted some truly outrageous reactions. We try to unpack the partisanship and tribalism at the root of these reactions as well as what all of this says about voters' shifting standards of conduct for political figures and communities of faith. Beth wishes we could take a look at Roy Moore's conduct on its own instead of trying to connect it to our personal political perspectives.

Sarah shares her perspective on stories that Sutherland Springs, Texas, is relying on faith to help cope with the devastating mass shooting that killed so many loved ones in the community. She draws on her experience from the shooting at Heath High School in 1997

We also discuss President Trump's trip to Asia, during which he complimented China's President, neglected to discuss human rights and democracy, and took Vladimir Putin at his word regarding Russian election attacks.

To compliment the other side, Sarah appreciates Kentucky Governor Matt Bevin's approach to sexual...

This year has held so much. Before we move into 2021, we wanted to hold space to reflect on the multitudes 2020 has contained. We will carry the lessons and scars of this year long into the future, so it felt worthy to take time to consider those and how this year has changed us.

19 Jul 2016How do we respond to chaos?00:40:09
Donald Trump has chosen Mike Pence as his running mate and we address the safety concerns being raised in Cleveland. We also try to absorb difficult news from Nice, Turkey, and Baton Rouge. What is the "mature response"? What does domestic abuse have to mass violence? And why is Sarah quoting Roger Ebert's review of Crash?

10 Jul 20189/11: The Day01:16:53

2,977 people were killed by 19 al Qaeda-backed terrorists on September 11, 2001. Today, as immigration and travel bans dominate the news, we begin a several month exploration of what that day has meant for American government, agencies, policies and culture.

We start the show lightning round to cover the this week's headlines. We're also sharing our first gratitude moment, a new regular segment in our Tuesday episodes.

11 Jan 2018#Oprah2020, DACA, and a Report from the Paducah City Commission00:41:58

The Briefcase is our shorter episode each week when we catch up on news and often share listener feedback. Today, we're covering a local fairness ordinance, the Oprah 2020 frenzy, and the public DACA meeting President Trump convened.

In our first block, Sarah emotionally describes the difficulty inherent in holding public meetings to pass a fairness ordinance in the city of Paducah, KY. Paducah is Kentucky's 9th city to pass protections for LGBTQ+ individuals. In this segment, Beth mentions the work of Equality Ohio to support state-wide fairness legislation in Ohio.

We then turn to the frenzied discussion of Oprah's presidential prospects -- which we believe misses the point of her speech entirely. In this discussion, we reference Susan Faludi's piece, The Patriachs Are Falling. The Patriarchy is Stronger Than Ever, and a conversation on Twitter resulting from listener M.E. sharing an article about soft skills in the tech industry. Unfortunately, we are unable to locate any nuance for the gentleman who is suing Google for discrimination

Finally, we break down the public negotiation President Trump convened on DACA -- we cover the good, the bad, and the ugly. We also give a brief overview of earmarks, since that seems to be on the President's mind.

  • host a conversation in your community about the threat of violence (agree in advance about whether you'd like to discuss gun control provisions or not)
  • contact your elected official to express your insistence on measures to combat gun violence

Post-note:

At the top of the episode, we cite the statistic from EveryTown that there have been 18 school shootings in 2018. This statistic has been criticized today by, among others, the Washington Post. EveryTown uses an expansive definition of school shooting to encompass every time a gun has discharged live rounds on school property. We encourage you to judge the meaning and importance of this statistic for yourself.

27 Apr 2018Women in the Freshman Class of the Virginia Legislature00:25:22

The Virginia House of Delegates seated a record number of women in January, and those women aren't messing around. We attended The Blue Victory Dinner in Arlington, Virginia and spoke to some of them about their successful campaigns and the importance of women in political leadership.

Thanks to our sponsors: SmartNews and Brandless.

She has a masters from VSU, a JD from the Thomas Jefferson School of Law, and twin boys, to whom she gave birth while on the campaign trail.

Wendy Gooditis, 10th district: An educator and local business operator, Wendy co-founded the Clarke County chapter of Indivisible following the November 2016 election. Her successful 2017 run was her first electoral campaign, which focused on education, jobs, health and the environment.

Danica Roem, 13th District: An award-winning journalist and Manassas native, Danica is the first transgender politician to be elected to Virginia's General Assembly. She out-raised her Republican opponent--a 25-year incumbent --by 5 to 1 with a campaign focused on economic and transportation issues.

Elizabeth Guzman, 31st district: A Peruvian-American public administrator and social worker, Elizabeth came to the United States as a single mom looking for a better future for her eldest child. She delivered the Spanish response to the 2018 State of the Union address at the invitation of House Speaker Nancy Pelosi.

Kathy Tran, 42nd district: Kathy is the first Vietnamese-American to be elected to the General Assembly and a former federal government employee. She came to the United States as a refugee and has spent her career advocating for workers, working families, and immigrants.

Hala Ayala, 51st district: A public servant and cyber security expert, Hala is one of the first Latinas to be elected to the General Assembly. A former vice president of the National Organization of Women (Virginia chapter), Hala has also served on former Governor McAuliffe's Council of Women and is an advocate for women and families.

Donald Trump, Jr.'s behavior has us reeling. Plus, we discuss Leah's feedback on our antitrust episode:

On antitrust, your discussion of the very grey area was so important. I'm a policy lawyer in the agricultural industry, and consolidation and mergers are a huge topic for our industry like most. Obviously, there are concerns about putting market share into less and less companies, and I share those concerns. At the same time, the costs, for example, of bringing new seed or a new drug to market are prohibitive and possibly insurmountable for any new/small company to actually hurdle. So, along with this discussion of what the corporations are doing to limit market access, is a question of, has the government through regulation or other means also (unintentionally) encouraged that consolidation and lack of market access? I'm totally in support of reasonable regulation and I see the need for a lot of the reviews/permits/etc that have to be done for many of these companies that create high tech solutions like seeds, pharmaceuticals/etc. At the same time, if those requirements are making it impossible for new innovation to be explored (and if that new innovation is not going to be properly funded through public research-but that's another issue) than aren't we (collectively as the govt/people demanding this) at least contributing to the issue of the consolidation?

We also appreciate our listener Sarah explaining that paper was indeed invented by a person at a specific time:

Sarah, you made an off-hand comment in the latest episode about how no one really invented paper, and societies all simultaneously invented it. It was actually invented in China in 105 AD by Tsai Lun. Papyrus, because it is woven, is not technically paper, so it was definitely invented in China at one time (approximately).

25 Aug 2017The Briefcase: A Tale of Two Trump Speeches00:33:18

This week, we heard from the President about his strategy in Afghanistan. Sarah was impressed that according to several reports the President spoke with soldiers before making decision and Beth reflects that most of her reaction was due to her lack of trust in Trump. We also discuss The Daily's reporting on the long-term strategy in Afghanistan with regard to Pakistan in particular.

Then, we watched him give a 77-minute speech during a campaign rally in Phoenix and talk about Ben Carson's presence and his continued attacks on the media. We also struggle with people continuing to support Trump. We reflect on our reactions to these two speeches.

We also discuss presidential pardons and this great Twitter thread on the subject (also don't miss the moment where Sarah confuses Chelsea Handler for Chelsea Manning!). We also talk about whether or not the Founding Fathers anticipated Trump.

19 Sep 2017Freeman High School Shooting, St. Louis Riots, the Graham-Cassidy Healthcare Plan, and Tax Reform01:07:49

Republicans have promised tax reform by the end of the year. We talk about tax policy, the Trump plan, and the goals of our tax code. We also discuss the tragic shooting at Freeman High School, the reactions to Jason Stockley's acquittal, and the healthcare plan proposed by Senators Graham and Cassidy. We end the show with thoughts on parenting and the Emmys.

Freeman High School. Sadly, Caleb Sharpe, a 15-year-old sophomore entered his school in Rockford, Washington, with an assault rifle and a pistol. He killed one classmate and injured three others before Joe Bowen, a janitor and military veteran, heroically intervened.  Sharpe, who had given indicators that he was a danger to himself, said he intended to teach a lesson on bullying.

St. Louis. In 2011, Jason Stockley, a police officer at the time, killed Anthony Smith during a drug stop. Following a bench trial, a judge acquitted Stockley of first-degree murder. We discuss the facts and the fallout from this verdict in a city struggling with racial tension and economic angst

Graham-Cassidy. Republicans are scrambling to pass healthcare reform in advance of the September 30 fiscal year end in order to set the table for tax reform. Senators Lindsay Graham and Bill Cassidy have proposed a new version of "repeal and replace" that would turn over funding and control to states. This Washington Post article succinctly explains the differences between various healthcare reform efforts and the Affordable Care Act. We discuss the issues with this plan and urge listeners who oppose the plan to take it seriously.

Compliment the Other Side. Beth compliments Senator Elizabeth Warren for working on legislation that would allow individuals to implement a credit freeze for free. Sarah compliments Congressman Will Hurd for comments on his recent Pod Save the World appearance

Tax Reform. We take a deeper dive into tax reform today given the administration's stated goal of passing comprehensive tax reform by the end of the year. As

14 Feb 2017Testing President Trump00:54:58

First up, Trump and Kellyanne fight with Nordstrom. Trump earlier this week tweeted that "My daughter Ivanka has been treated so unfairly by @Nordstrom. She is a great person – always pushing me to do the right thing! Terrible!" (And it was retweeted by the official @POTUS account)

Then, Kellyanne stated on Fox & Friends: "Go buy Ivanka's stuff, is what I would tell you," Conway said. "It's a wonderful line. I own some of it. I fully -- I'm going to just, I'm going to give a free commercial here: Go buy it today, everybody. You can find it online."

The comments could run afoul of a federal law that bars public employees from making an "endorsement of any product, service or enterprise, or for the private gain of friends, relatives, or persons with whom the employee is affiliated in a nongovernmental capacity."

James Nuzzo, a legal scholar and founder of the Colchester Group consulting firm, took a closer look at President Trump's tweet and noticed something very important was missing: Specifics. All the tweet accuses Nordstrom of "doing" is being "very unfair," Nuzzo points out. Any lawsuit the company brings against Mr. Trump would have almost no chance of success. Moreover, the U.S. Supreme Court has made it clear that only factual misrepresentation, in other words specific lies — not opinion — would be considered libel or slander. And the tweet almost seems to have been crafted very wisely with that precedent in mind. Someone saying another person or company is "unfair" is almost the definition of an opinion as "fairness" cannot really be defined legally or otherwise. In short, don't expect President Trump to get a slap on the wrist or any other kind of slap from the courts over this.

Congress is a different matter. A much stronger argument could be made that Congress could officially censure President Trump for his conduct connected to the tweet against Nordstrom and several others like it that specifically attacked or demeaned businesses and individuals.

Plus, we ask Just how much trouble is Michael Flynn in? and talk about North Korea conducts ballistic missile test.

In the Suit, we talk about Washington v. Trump and do our best to summarize the decision.

  1. The procedural history of 9th Circuit decision:
  2. A. The state of Washington went to federal district court asking for a temporary restraining order (TRO). When a hearing happens, Washington wants a declaration that the order is illegal and unconstitutional and permanently enjoined from enforcement. (Minnesota jumped in as a plaintiff, too)The District Judge granted that TRO. The President asked the 9th circuit to stay the TRO. So, Washington said, “STOP enforcing this EO until a full hearing can happen.” The district court did. Then the President said to the circuit court “stop the district court’s order stopping my order until a full hearing can happen. And the 9th circuit said, “nope, we’re going with that restraining order.”
  3. Standing — cases and controversies — you can only bring a lawsuit if you have a particular and specific, non-theoretical injury that a court could actually redress. The states of Washington and Minnesota said that they were harmed because the EO kept people from coming to their public universities and the states are...
