20 Jan 2018#2: Michael Lacy – Don’t let the law get in the way of your argument01:02:46

In this episode of “Of Counsel”, we hear from President of the Criminal Lawyers’ Association, Michael Lacy.  Join us as we listen to Michael discuss the lessons he has learned over his many years in an illustrative career in criminal law.

Looking back on Michael’s career in law is overwhelming in accomplishments and notoriety.  The cases he has defended are some of the most well known in the nation.  Now partner with Brauti Thorning Zibarras in Toronto, Michael's future ahead continues with some of the most anticipated cases in Canadian news. And, unlike many litigators who restrict themselves to either trials or appeals, Michael is equally accomplished as an appellate lawyer appearance in the Ontario Court of Appeal and Supreme Court of Canada on countless occasions.

Michael’s participation in the criminal justice system does not end at his clients. Over the years Michael’s contributions have enhanced the bar as a whole.  He is an instructor with Osgoode Law School, an author to several publications and bulletins and a frequent speaker at conferences throughout North America for lawyers, prosecutors, police, and judges.

Above all, Michael has harnessed his skill and dedication in criminal law to actively leading one of the largest criminal lawyers associations in the world. As President of the Criminal Lawyers’ Association, Michael continues to fight for the constitutional rights of Canadians and for those lawyers who defend them. With significant cutbacks in Legal Aid, increasing complexity in the Court system, expanding police powers, degradation of privacy rights, and evaporation of procedural protections in court on the horizon, there is no doubt Micheal’s term as President brings with it serious challenges.

And for those reasons, there is no better time than the present to have an advocate like Michael leading lawyers like him in protecting the rights of Canadians.

03 Jun 2018#17: The Ryerson Law Practice Program: Gina Alexandris, André Bacchus, and Chris Bentley01:11:13

Recognizing a need for alternative pathways for graduated law students to successfully advance to lawyers, the Law Society launched the Law Practice Program in 2014. The initiative was bold and met with controversy among the bar. Many saw the program as redundant, substandard, and exacerbating the problem of unemployment among recently called lawyers.

In only 3 short years, the Ryerson LPP program would not only prove their critics wrong by actually creating employment opportunities for lawyers, but also exemplified a comprehensive, innovative, and practical articling experience.

In 2018, the LPP program has a long list of successful placements and permanent employment for their candidates in banks, Bay St., insurance, criminal and constitutional law, and almost all the areas that those outside the LPP aspire towards.

However, the overwhelming success of the program would not have come without the passion, perseverance, and wisdom of our three guests today. Gina Alexandris, André Bacchus, and Chris Bentley who combined their impressive backgrounds from legal education, Bay St., and politics to form what the LPP is today.

10 Jul 2018#20: Michael J. Bryant: The Circumstance of Equals01:14:10

This episode's guest is former Attorney General of Ontario, Micheal Bryant.

Michael's personal story in law is one that spans the entire spectrum of the justice system. After clerking at the Supreme Court of Canada with former Chief Justice Beverly McLachlin, and obtaining an LL.M. as a Fulbright scholar at Harvard, Michael moved seamlessly into the Bay St. elite.  From there, he transitioned into politics where he then became the youngest person ever appointed as Attorney General.

His time as the top lawyer in the Province was filled with productvity, excitement, legislative changes, and controversy. No one ever dreamed it would all come to such an abrupt halt in 2009 when Michael was charged with dangerous driving causing death and criminal negligence causing death. Although this may have marked the end of anyone's else's career in law, for Michael it was the beginning to a very different direction. After extensive investigation and a formidable defence, his charges were withdrawn at the request of the Crown.  Michael then spent the next several years recalibrating his objectives and motives in law.

In 2015, Michael moved into private practice where he spent a considerable amount of time representing indigent accused with Ontario's Legal Aid system in bail court, and on individual certificates. Applying his own experiences within the system and how accused are treated by the Courts made him a truly unique and powerful voice among the defence bar. In 2018, Michael channeled his passion into broader issues affecting all Canadians by becoming the Executive Director of the Canadian Civil Liberties Association where he now advocates for Canadians' constitutional rights.

Join us to hear about this amazing journey and the lessons Michael has learned from it all.

09 Dec 2018#31: Donald Bayne: the threat against the rule of law.01:03:12

In the course of practicing for over 40 years, Donald Bayne has entrenched himself as one of the best criminal defence lawyers Canada has ever known. Despite this, his humility, compassion for human suffering, and pursuit of justice is as vibrant as it was when he first became a lawyer.

Don's remarkable journey in his pursuit of justice takes us from a farm on the prairies, to varsity football fields, to travelling with the KGB in the Soviet Union at the height of the Cold War.

His past cases are some of Canada's most well known and include acting as defence counsel for Senator Mike Duffy, acting for the coroner in the Ashley Smith Inquiry, and more recently his endless efforts opposing, and now correcting what seems a clear error and injustice, of his client Hassan Diab's extradition from Canada.

The release of this particular episode comes at a time when Canadian extradition laws are the topic of worldwide media after the recent arrest of Meng Wanzhou of Huawei as she awaits for a bail hearing and likely deportation to the United States on allegations of US Iran sanction violations.

Some leaders, like Douglas Judson and Heather Donkers, can be found in law schools or as junior councillors in small towns in Ontario. Despite their current positions, these leaders and influencers have a promising future ahead of them.

In this episode of Of Counsel, we interview a former and present president of the Law Students' Society of Ontario. While they may not be well-known to senior lawyers, they have made significant contributions in advancing the interests of law students and recent members of the legal profession.

During the interview, Heather and Douglas discuss what it's like to be a newly licensed lawyer or law student in 2019 and how much the legal profession has changed in the past 20, 10, and even 5 years. This is an important listen for any lawyer who wants to understand the challenges faced by recent calls and the sense of abandonment and hopelessness that some may feel as they enter the profession. With the upcoming Bencher election, it's more critical than ever to listen to their voices and understand why we need to change as a profession to save it.
