While staff at the Mississippi Library Commission can’t provide legal advice, they can look up specific statutes and court cases for patrons. The library has a subscription to a Legal Forms database that has Mississippi-specific forms on a variety of topics, from name changes to divorce to simple wills. It also has a notary on staff and can direct patrons to the appropriate circuit or chancery court in order to find out more information about filing the forms themselves.

Professor Richard Gershon from the University of Mississippi School of Law gives his opinion on the new state laws that take affect July 1, 2019 in Mississippi.

There will be a run off for some elected positions August 27th – 2 weeks from today. November 5th is the next general election in Mississippi. All our senators and representatives along with the statewide offices will be selected on that date. If you voted in the primary you can only vote in the same primary on the 27th. If you didn’t vote in the primary you can vote in either runoff primary. If you didn’t vote in the primary, you can still vote in the general election. 

Citizens need to register by October 7th to vote in the November 5th general election for Governor, Lt. Gov. and such. There are county positions that need to be filled by election in November also. Teens don’t need to be 18 by October 7th to register, just 18 by November 5th.  AND if you didn’t vote in the primary you can still vote in the general election.

PROPERTY OWNER LIABILITY — Senate Bill 2901 , called the "Landowners Protection Act," says that anyone who owns, leases, operates, or maintains a commercial property in Mississippi will not be liable for any injury on the property caused by another person, unless the person in charge of the property did something that "impelled" the harmful action. Supporters say the new law will provide financial protection for property owners or managers, while critics say it could lead to negligence.

NEW DATE: Beginning May 3, 2023, every air traveler 18 years of age and older will need a REAL ID-compliant driver’s license, state-issued enhanced driver’s license, or another acceptable form of ID to fly within the United States. https://www.tsa.gov/real-id

The REAL ID Act establishes minimum security standards for license issuance and production and prohibits Federal agencies from accepting for certain purposes driver’s licenses and identification cards from states not meeting the Act’s minimum standards. The purposes covered by the Act are: accessing Federal facilities, entering nuclear power plants, and, boarding federally regulated commercial aircraft.

  • The eviction moratorium operates by restricting lessors of covered properties # from filing new eviction actions for non-payment of rent, and also prohibits “charging fees, penalties, or other charges to the tenant related to such nonpayment of rent.” Sec. 4024(b). To know I couldn’t receive my medicine in Mississippi is heartbreaking. I went to my general physician, he prescribed marijuana, I registered with the state, and the state sent me a card license.  Marijuana is medical. Consider the epileptics! It was scheduled as a class 1 drug as a tool to suppress the Black community. The gentleman it is an illegal drug is simply a “crafting of words” as he says. Marijuana is not a drug. Marijuana can not be overdosed on. Marijuana is not addictive. There should be no fear mongering of this highly necessary medicine.

Curtis Flowers was tried for murder six times in Mississippi. Four of the trials resulted in convictions, all of which were overturned on appeal. The U.S. Supreme Court reviewed Flowers' case. It overturned, on a 7–2 vote, the murder convictions in June 2019 in the decision Flowers v. Mississippi. In December 2019, Flowers was released from prison for the first time since his original arrest. On September 4th, 2020, the Attorney General for Mississippi announced she would not seek a seventh trial and had dropped the charges against Flowers.

To see a sample ballot for your street address, go to yallvote.ms. This will take you to the MS Sec of State’s website. Scroll down to Poling place locator. Type in your address. Your address should pop up, along with your poling place, and your Circuit Clerk’s name and phone number. Below that is what is on YOUR ballot. Everyone will vote for President and Senator. Your ballot will be different from MY ballot in that You’ll have your US representative, election commissioner and your supreme court justice races listed.

Voters who require assistance in marking the ballot because of disability, blindness, or an inability to read or write are entitled to receive assistance from a person of the voter’s choice, excluding, a candidate whose name is on the ballot, or a poll watcher who is observing in the polling place on Election Day. 

Rules prevent people from wearing campaign-related clothes or caps into the polling place. And people campaigning for a person or issue on the ballot must remain 150 feet from the polling place. Sec of State Watson said this rule applies only to signage or clothing pertaining to “anything that’s on the ballot,” but would not prohibit other messaging not directly up for a vote. Can I deduct home office expenses while I'm working from home? It depends. The short answer is, probably not. If you work full-time for someone else, you're out of luck. The people most likely to be eligible to claim the home office tax deduction are those who are self-employed -- meaning they run their own business out of their homes, or are independent contractors or freelancers working on assignments from home. And you may not deduct expenses related to anything that is used for both your work and your home life.

Virtual Public Briefing The Civil Rights Implications of Cash Bail February 26, 2021 | Washington, DC

 The U.S. Commission on Civil Rights will hold a virtual briefing on February 26, 2021, on bail reform in the United States. The Commission’s investigation seeks to examine the state of bail and pretrial detention practices, including the involvement of the private bail industry, various mechanisms for reform, and the potential regulatory role of the federal government. The Commission will evaluate how cash bail impacts the fair administration of justice and whether it operates in a manner that denies equal protection of the law to individuals on the basis of race or another protected class.

At this public briefing, Commissioners will hear from subject matter experts such as government officials, academics, law enforcement professionals, advocates, and impacted persons. The Commission will accept written materials from the public for consideration as we prepare our report; submit to bailreform@usccr.gov no later than March 26, 2021.

CHECKLIST THINGS TO DO WHEN A PERSON DIES

  • Notify immediate family and close friends
  • Evaluate the emotional impact on the surviving spouse, children and close relatives and friends; arrange for support
  • Deal with donation of bodily organs to an "organ bank." as appropriate
  • Arrange care for dependents, if any
  • Notify attending physician or coroner
  • Arrange care for pets, if any
  • Evaluate the need for security at Decedent's residence
  • Cancel or rearrange home deliveries?
  • Have Post Office hold mail?
  • Find perishable property (food, plants, etc.), arrange for care or disposal
  • Find and review Decedent's expressed funeral and burial wishes
  • Notify agent under any power of attorney
  • Prepare and arrange for obituary
  • Arrange for mortuary, cemetery, burial, cremation, as appropriate
  • Arrange funeral/burial services
  • Notify other members of family and friends
  • Keep records of all payments for funeral and other expenses
  • Locate safe deposit box(es); follow safe deposit box procedures (see page 2)
  • Locate wills, codicils, trusts
  • Locate life insurance policies
  • Locate other important documents, relationships, accounts, investments, etc.
  • Advise Social Security, Medi-Cal, other agencies as appropriate
  • Investigate social security benefits
  • Investigate life insurance
  • Investigate union death benefits
  • Investigate veterans burial allowance and other benefits
  • Investigate fraternal organizations
  • Investigate employee benefits, including accrued vacation pay, death benefits, final wages, retirement plans, deferred compensation, medical reimbursements,
  • Investigate refunds on insurance or canceled subscriptions
  • Investigate Keogh and IRA accounts
  • Investigate business, partnership and investment arrangements
  • Retain and meet with attorney regarding estate matters
  • Retain and meet with CPA as to tax and accounting matters
  • Meet with life insurance agent to collect proceeds or consider options
  • Obtain death certificates (ask attorney how many are needed)
  • Deal with fire, theft, liability and auto insurance on Decedent's property
  • Work with attorney and CPA to prepare inventory, list of accounts and list of debts
  • Review credit cards and charge accounts, cancel as appropriate
  • DO NOT pay any of Decedent's debts until attorney discusses with family or executor
  • Obtain valuations of assets, as appropriate
  • If Trust involved, arrange for any allocations and transfers
  • Arrange for final income tax return and estate tax return, as necessary


Safe Deposit Box Access Procedures

Suggestion: If there is any danger of a will or trust contest, or a conflict between executor, trustee, family or beneficiaries, DO NOT go to safe deposit box without the involvement of an attorney experienced with estate administration.

Owner(s) Deceased: California Probate Code§ 331 authorizes a person who has the key to a safe deposit box of a deceased person to have access to the box, even before any action has been taken with the probate court. The financial institution shall first obtain proof of the decedents death and reasonable proof of the identity of the person seeking access. The person may then:

1. open the box (under the supervision of an officer or employee of the financial institution),

2. make an inventory of the contents,

3. remove instructions for disposition of the decedent's remains, and

4. after copies have been made and placed in the box, remove wills and trust instruments.

Except for the disposition instructions, wills and trust instruments, no other contents shall be removed under these provisions. The person shall deliver all wills found in the box to the clerk of the superior court, and mail or deliver a copy to the person named as executor.

Surviving Co-Owner(s): Surviving Co-Owners have the right to access, as provided in their agreements with the financial institution. When accessing a safe deposit box after the death of a co-owner:

1. At least two people should be present at the first opening, and should make an inventory of the contents in detail on letter size paper, with both persons signing and dating the paper.

2. After copies have been made and placed in the box, remove documents as needed.

 Families in the U.S. and territories qualify for the newly expanded CTC. Joint filers making up to $150,000, single head of households making up to $112,500, and other single filers making up to $75,000 qualify for the full advanced periodic payment of the CTC. In a very positive change from the current law, the expansion of the Child Tax Credit in the American Rescue Plan means that you do not have to be employed to receive the benefit; even families who have no income at all will be eligible.

If you are unmarried and earn less than $112,500 per year or are married and your household income is less than $150,000 per year, you will receive $3,600 per child under six years old and $3,000 per child age six to 17. Estimates project that families will receive about $300 per child for children under six, and $250 per child between ages six and 17, for each periodic payment.

So, for example, if you have one child, aged seven, you will receive $3,000 over the course of a year, or $250 per month.

The cash benefit begins to reduce by $50 for every additional $1,000 of income earned. Higher-income families who previously qualified are still eligible for the $2,000 per child benefit for individuals making up to $200,000 and joint filers making up to $400,000. Meaning, they will not receive less than what they previously did under current law.

Tax Changes that are proposed for the current congress:

  • The top individual federal income tax rate would rise from 37% to the pre-Trump rate of 39.6%.
  • The corporate rate would rise from 21% to 28%; a 15% alternative minimum tax would apply to corporate book income of $100 million and higher.
  • Individuals earning $400,000 or more would pay additional payroll taxes.
  • The maximum Child and Dependent Tax Credit would rise from $3,000 to $8,000 ($16,000 for more than one dependent).
  • Tax relief would be offered for student debt forgiveness and the first-time homebuyers’ credit would be restored.
  • The estate tax exemption would drop by about 50%.
