Hi there Welcome to the very first edition of the Employment Rights Online podcast, where we discuss everything 'employment rights' and "the job". It's great to have you on board. Remember to subscribe to the podcast where you're listening to this episode. I don't want you to miss a thing. If you're reading the show notes to get your 'Grievance' freebie download, you can get that by using this link here. So, why employment rights you might ask? Well, we have never had so much uncertainty about employment status and the question being asked, is whether ever worker is the same. Workers are wondering whether their gigger status, or IR35 status, or zero hours contact status, or permanent contact or term time working, are all the same and whether everyone working on these types of contacts, are entitled to the same employment rights. The answer to this is 'NO', but the uncertainty about where to get the information about contacts and rights can be difficult to pin down - and that's why we're here! Over the coming weeks, we'll discuss a range of employment rights and job-related topics over the airwaves - the aim being, to shed light on some of the answers people are looking for, in these areas. Hi there I hope you’re keeping up with the never-ending changes that surround the government’s covid plans. For those of you who may have missed it - in the last week there’s been yet another update to the old furlough scheme, which became the Job Support Scheme. The old Job Support Scheme which was due to come online on 1st November 2020, has now become the Job support scheme mark 2 and there are some changes to get our heads around! In this week’s episode, we look at the new additions to the Job Support Scheme and also touch on the question of who is eligible to receive help. Remember, if you feel you have been treated unfairly at work, the first thing you need to consider is submitting a complaint or a grievance - to ask your employer to investigate your concerns. Hi Everyone I hope you’re having a great employment rights week, as we move further towards full return to the workplace. This week we have another listener’s question, which is a great question - and one which came off the back of last week’s podcast episode about the employment status of agency workers. In fact, it’s such a good question, we changed the schedule a little, to answer the question in this week’s podcast episode. The question we were asked is “ What if I applied for a job as a worker, but when I started the job and got my first months wages, my employer told me that I have to pay my own tax and national insurance because I’m self employed? Does that make me an agency worker? Is this right?” There are some really useful tips you can use to address this type of concern, if this question speaks to a similar problem you’re having with your employer. Hi there In this week’s podcast episode, we continue our series, looking in detail at the different types of paid and unpaid leave that you may be entitled to receive at work. In episode 36 of the podcast, we looked at Unpaid Parental Leave. In this week’s episode of the podcast, we’re going to look at Shared Parental Leave, which is a different type of leave altogether, and is form of paid leave that is in place for parents who want to take time off after their baby is born or after your adopted child comes to live with you. The leave must be taken in the first year of your child’s life or after your adopted child is placed with you. If you or your partner apply for Shared Parental Leave you may also be able to claim Shared Parental Pay and if you qualify for both elements, that’s the leave and the pay - you and your partner could share up to 50 weeks of leave and up to 37 weeks of pay between you. Hi everyone We hope you are continuing to keep your spirits as high as you can, during the lockdown. Like you, we hope it’s over soon. We’ve reached a milestone this week, in that our podcast is a year old today and we’re super pleased about that. We started the podcast just before the lockdown, not quite knowing how it would be received after lockdown started. But looking at how much you engage with the podcast, it’s clear we had nothing to worry about. Hi there This week we are into the last week of our mini-series on treatment at work having covered bullying in the first part of the series and harassment in the second part of the series. This week we conclude the series looking at victimisation at work and how you will know if you have been a victim of this. Victimisation unlike bullying is covered by law under the Equality Act 2010 and a definition of victimisation is when you are treated badly because you complain about discrimination or you help someone who has been discriminated against. This is called victimisation. We explore this employment right in more detail, in this week’s episode. This week we’re still looking at age discrimination, but this time we look at age discrimination in recruitment and selection processes, because it is still against the law - or the Equality Act (2010) in particular, to fail to recruit someone to a job because of anything to do with their age, or because of a belief or bias of the recruiter, that person is too old or too young for the job. We look at this principle using a recent case that was successful at an Employment Tribunal. If something like this has happened to you… you should consider seeking legal advice from ACAS, a Citizens Advice bureaus or a law centre, if you decide to bring your case to an Employment Tribunal. Not much has come out at all since our podcast last week, but you can bet that there is much churning going on in government, when the question of how to open up society and get people back to work in a safe way, is discussed. One good thing that has come up this week, is the recommendation that employment tribunals extend their deadlines for submitting claims rom the current three months to six months. In this weeks podcast episode, I explore this recommendation in detail looking at the implications for the current arrangements as a way to highlight why and extension in tribunal submission timelines, would really benefit workers – with benefits badly needed as a result of the impact of coronavirus working conditions. This week we continue our series… looking in detail at the different types of paid and unpaid leave that you may be entitled to receive at work. In this week’s episode …we take a look at the top seven things you need to know about … if you want to take emergency time off to care for family and dependents… more commonly known as dependent leave. Dependent leave is time off from work that you can legally take, to deal with an emergency involving a dependent. A dependant could be a child, grandchild, spouse, a parent or anyone who would normally or reasonably rely on you for assistance. There is no legal amount of time off you can take, but your employer is expected to allow you enough time off to deal with the emergency. Legally, your employer does not have to pay you when you are off but your contract of employment should tell you how your employer’s dependent leave process works. In this week’s episode, we look at the seven key pieces of employment rights information you need to know about dependent leave. I hope you’re having a positive employment rights week. This week we’re looking at the arrangements for dealing with bullying and harassment at work … as people start returning to work in greater numbers. Research shows that at least one in four workers experience some form of bullying or harassment at work … but oftentimes workers are unclear that from an employment rights position… bullying and harassment are defined differently and are addressed in different parts of employment law. In this week’s episode, we look at the definitions of bullying and harassment; we also look at examples of some of the behaviour associated with being bullied or harassed at work; and, finally, we look at how you can challenge bullying or harassment in the workplace. The key point to remember, is that you should not put up with bullying or harassment, and the way to break free from this treatment - is to tell someone! Hey there I hope your doing well and managing to stay safe, in what could well be the sixth week of working from home for some and several weeks into lockdown for most people. I wanted to touch on a question that came up in a conversation I was having with someone making an enquiry about their employment rights. The question was - whether his employer would find out that he had received a police fine for breaking lockdown restrictions. And, whilst my answer to that question was that I didn’t know, it did raise other points of concern for me because even though we are all on lockdown and we haven’t seen our workplaces for several weeks - if we are still employed - then we are still bound by our employer’s code of conduct. So this week, I want to talk about problems that could arise when you mix conduct at work with being on lockdown. Things may be tough whilst you’re on lockdown. But if you’re still tied to your employer, and therefore you need to be aware of your conduct both during and after working hours, to be sure you don’t fall foul of breaching behaviour policies at work. I spoke to my boss about this three months ago, but instead of doing something about it he just lets them make more allegations against me and keeps on investigating me. It’s never-ending. Is there anything I can do about this because I feel I have lost my job through no fault of my own?” So, this week we focus on answering this question in terms of the steps we advised the worker to take. Now, here at ERO, we appreciate that businesses have to make tough decisions at this time, and this will inevitably include people being made redundant. This week we bring you a case of a worker who was never told she was going to be made redundant and instead, thought she had a job and was merely furloughed because of covid. The worker was pregnant and believed the employer chose her for redundancy because of her pregnancy, which if true, would be illegal under the Equality Act 2010. The regulations were actually updated on 06/04/2020. Whereas calculations for holiday pay, for people on fixed hours and rates of pay, has always been relatively standard, for people who work irregular hours or who are on Zero Hours Contracts, this has not been the case. There have been long standing disputes about how holiday pay is worked out for this latter group of workers, and it’s this particular dispute, which the new regulations were created to address. Hi there We hope you are having a positive employment rights week. This week, we’re into part two of three of our miniseries looking at suspensions and in particular, what to look for as evidence that your suspension might be unfair. In this episode, we’ll look at seven key actions your employer should take to evidence fairness of your suspension – actions that you need to be aware of if you want to check that your suspension has been handled fairly. The take away for this week, is that, for your employer to maintain that duty of mutual trust and confidence, under no circumstances should you be suspended as punishment during the course of an investigation. Neither should your suspension be allowed to prejudice the investigation into your alleged misconduct, or influence the person who will be dealing with your disciplinary, or influence the way in which that person will deal with your disciplinary. At all times, your suspension should imply no fault or guilt about you. Hi There Remember to use your employment rights to protect your right to work in peace. You are entitled to do this, even when things have gone wrong at work. This week, we are into the final part of our mini-series on suspensions, where we take a look at what you need to be aware of, when you are returned to work after a suspension. This return to work period can be a bit tricky because you almost feel like you are under a microscope. So, we take you through six actions you can take, to reduce opportunities for problems to occur. If we can reduce back to work frictions, this will give you the time, to settle and work towards things getting back to normal. Our take aways for this week are, that if you are returned to work after a suspension, you need to be alert to the next steps you may have to take irrespective of whether you are found innocent of allegations made against you or the allegations against you have been proven. The key is to know what is expected of you. Our take aways from this week’s episode are: that you now do not have to see your GP to get a fit note. Instead, other health professionals can now authorise your sick leave or return you to work with amendment, designed to facilitate your early return to work. Hi there When your bully seems to act as if you are the workplace entertainment… it’s time to put yourself first… and take steps to put them on show. Firstly, not great news. Unfortunately, we have been hit by the covid bug and this has affected our team, to the extent that we have to cancel our Bullying Surgery. We are a small but mighty team, but this one has sent us to ground including the late uploading of this week’s podcast episode, which had to be delayed to include this short message. We send our sincere apologies for this. We’ll be writing to all our surgery registrants to let you know what the next steps will be… and we’ll try to reschedule the surgery as soon as possible in 2023. This week we look at the lifespan of a workplace bully. The lifespan of a workplace bully refers to the ways in which your bully can develop skills and systems of bullying over long periods of time where their behaviour remains unchallenged. Hey there We hope you are growing in faith and confidence about the importance of using your employment rights to put your employer on notice about you right to be treated fairly and respectfully at work. This week we go back to an employment rights issue which has recently seen a development in the publication of a draft code of practice on fire and rehire procedures, which is out for consultation until 18th April 2023. The draft code sets out employers’ responsibilities when seeking to change employment terms and conditions, if there is the prospect of dismissal and re-engagement. It requires employers to consult staff and explore alternative options, without using the threat of dismissal to pressure employees to agree new terms. In this week’s episode, we look at the draft code in more detail and we explore the requirements which will be placed on employers to ensure employees are treated fairly in fire and rehire situations.
