15 Sep 2024163 - Joe Fried – $16.2 Million Verdict in Pioneering Case against Amazon01:18:32

Renowned trucking accident lawyer Joe Fried tried the second case in the nation and the first in Georgia to test Amazon’s claims that it has no responsibility for its drivers’ conduct.

The result was a $16.2 million verdict against Amazon for pain and suffering endured by his client’s son, an 8-year-old boy who was run over by a delivery van. As Joe explains to host Michael Cowen, the groundbreaking case offers unique teaching opportunities for plaintiffs’ lawyers. Among the successful strategies: his team’s focus on exposing how the driver was himself a victim of Amazon, which places drivers under immense pressure. “The jury agreed with us on that in that regard.”

Both Joe and Michael will share their insights about trucking accident law this fall.

First, Joe will discuss the Amazon case at the Academy of Truck Accident Attorneys Annual Symposium, to be held in Nashville from September 25 to 27.

Then, Joe and Michael will join the faculty at TLU Vegas, October 16-19 at Caesars Palace. Joe will present about the case, and Michael will lead a masterclass on trucking.

31 Aug 2024162 - Jessica Brylo – Harnessing the Power of Big Data and Focus Groups00:49:27

15 Jun 2023132 - Malorie Peacock - The Hidden Power of Lay Witnesses00:38:30

Lay witnesses. Whether you call them eyewitnesses, ‘before and after’ witnesses, or damages witnesses, you need them to help you make your case. And sometimes the most unexpected ordinary people can be the greatest witnesses.

“There's obvious ones like the spouse or the children or family members of your plaintiff. But beyond that, there's coworkers, there's neighbors, there's the pastor, there's the guy that runs a corner store at the end of the block, their kid’s teacher…it could be a whole universe of people out there.”

On this episode of Trial Lawyer Nation, Michael Cowen and Malorie Peacock explore how to identify potential lay witnesses and the importance of building trust with these witnesses to ensure that they feel comfortable disclosing pertinent information. They also examine the importance of obtaining visual evidence, such as photos and videos, to make events more real for jurors. But when it comes to getting these lay witnesses, lawyers have to be willing to do the legwork.

Tune in to gain valuable insights and strategies for building a compelling case through effective lay witnesses.

15 Jan 2025171 - Jason Hennessey – You Can’t Control Google’s Algorithm; You Can Master Digital Marketing00:43:39

When it came time to name his book, Jason Hennessey left nothing to chance. Anyone searching for “law firm SEO” would find his agency, videos, and his book: “Law Firm SEO.” “I'm dominating that keyword, and it's all by design.”

With host Michael Cowen, Jason defines words in the digital marketing dictionary like “SEO” and “LSAs.” He pulls back the curtain on the Google algorithm. And he describes strategies to get the phone to ring. His main advice for lawyers is to take action. As an example, he congratulates Michael for his idea to send videos to potential referrals. “And as a result of that, you are able to post those large checks on social media because you're building these new referral partners. But what if you didn’t take action?”

Episode Highlights

[03:03] What is SEO? It stands for “Search Engine Optimization,” and it’s not taught in school. Jason began his SEO education while working as a DJ in college.

[05:03] “Law Firm SEO”: Michael wrote this book to empower lawyers so they’re not taken advantage of by a huckster promising to get them on page 1 of Google.

[11:56] The Competition: Google has made it harder for personal injury marketing over the years. While firms could generate leads with advanced SEO strategies, “it’s not as easy anymore,” Jason observes.

[16:39] It’s the Optics: Jason outlines why Google reviews are important: perception, competitive ranking, and keywords.

[19:03] When to Get the Review: Jason argues that a lawyer should seek a client review at the beginning of a case rather than waiting until the case ends.

[20:10] Go Deep or Wide? With a tight marketing budget in a competitive market, a law firm could either limit marketing based on geography or target marketing based on practice area. Jason describes both strategies.

[24:28] ‘To Thine Own Self…” Use stunts to lure social media views if that’s your style. The important thing, Jason says, is to stay true to yourself.

Just focus on your biggest PI cases. Afterall, that’s where you make the most money and the biggest difference, so it should be easy. Right? Wrong. Before you know it, you’ve spent the majority of your time working on cases where you’re just trying to get your expenses back, and not working enough on your big cases. So how do you make sure you actually focus your attention on where it is needed the most?

In this episode of Trial Lawyer Nation, Michael Cowen and Malorie Peacock discuss strategies they’ve used to keep their focus on their biggest cases. They share why you need to intentionally identify your top cases to avoid “the whirlwind”, how to create a culture where you can have “accountability meetings” with fellow lawyers in your firm that are useful (and don’t run people off), and how to figure out the places where you can and should delegate.

31 Jul 2023135 - Amy Hall - The “Formula” for Effective Visual Trial Strategy01:01:18

Lawyers know their cases backwards and forwards. However, jurors may need help honing in on the most important elements of a case. Visual trial strategy helps create a series of clear, tailored exhibits to present to a jury at trial.

On this episode of Trial Lawyer Nation, Michael Cowen talks to visual trial strategist, Amy Hall. Amy discusses her tried-and-true three-exhibit formula–the anchor, the link, and the payoff–which she uses to distill everything in a complex case into these three themes. Additionally, Amy explains that because jurors learn better by combining both visual and auditory means, she always recommends using physical exhibits while presenting your case instead of fumbling over technology.

Tune in to learn how to employ visual trial strategy to guide juries through trials.

31 Jul 2024160 - Bruce Inosencio – The Four Words that Drove His Record-Setting Verdict00:42:30

“Statistics suck. Stories stick.”

For Bruce Inosencio, this motto proved a north star guiding his case against a Michigan nursing home. With host Michael Cowen, Bruce acknowledges the challenge he faced: How to prove that the facility owed damages when the patient was an elderly, sick woman?

To do so, he and his legal team connected with the jurors so they’d be invested in the story of the 87-year-old woman’s life. He combatted the defense argument that an elderly woman’s life was somehow less valuable. The statistics of her experience at the facility mattered, but the stories that Bruce told drove the verdict. They awarded $6 million to her surviving daughters, a record in Michigan. Tune in to hear Bruce explain why the story, not statistics, won the day.

Lawyers constantly receive training in the form of CLE. However, training staff members in the day-to-day running of a law office is no less important to a successful practice. 15 Jul 2023134 - Sonia Rodriguez - Cracking the Expert Witness Code: Getting the Best from Your Retained Experts00:36:21

“The relationship between the expert and the lawyer is a lot like a horse and a rider. I don't want you to lead me in a dangerous situation, and I don't want to lead you in a dangerous situation.”

On this episode of Trial Lawyer Nation, host Michael Cowen is joined by his partner Sonia Rodriguez, for a discussion on the dos and don’ts of working with retained expert witnesses. Sonia and Michael discuss the importance of consistent communication with your expert and remembering that while they may be the expert in their field, you’re the expert in the courtroom. Experts are equipped with technical knowledge, but when it comes to getting a jury to believe your story, it’s best to keep things simple. Just like a rider guides a horse, lawyers must guide their experts–the expert must know why they’ve been hired and how the lawyer sees them fitting in the case.

31 Oct 2023141 - Malorie Peacock - How Michael and Malorie Got a $17.5 Million Verdict in a Tough Case (Part 2)00:44:01

Trial is not a law school exam.  Just because you can technically put in evidence of certain elements of damages, doesn’t mean it's in the client’s best interest to do so. On this episode of Trial Lawyer Nation, Michael Cowen and Malorie Peacock continue their discussion on how they overcame the odds to win $17.5M in damages for their client in a case against a forklift manufacturer. In this part two of the series, Michael and Malorie share insight on how they told the client’s damages story.  Tune in to learn why they presented the client as a strong superhero, how they found a different story for each of the damages witnesses to tell, why you should use the KING flipchart, and the persuasiveness of the “want ad” technique when asking for compensation.

As a trucking trial lawyer, if you are compassionate, people can walk all over you and you won’t get good results, you need to be both fierce and compassionate.

On this episode of Trial Lawyer Nation, Michael Cowen and Michael Leizerman discuss the ins and outs of wrongful death litigation. Leizerman draws on his experience as a truck accident lawyer and shares the strategies he used to win a recent $18 million verdict.

30 Nov 2024168 - Mike Alder – Why Lawyers Need Discipline, Consistency, and a Spiked Meditation Mat00:35:25

Three decades as a trial lawyer; 30 trials; more than $3 billion in verdicts and settlements; thriving practices: Ask Mike Alder how he does it, and his answer is simple.

“Take a cold shower and make your bed.”

Make your bed, every day, because it teaches the discipline a trial lawyer needs. Prefer a warm shower? Take a cold one anyway, because stepping outside your comfort zone prepares a trial lawyer for dealing with stressful situations.

In this wide-ranging conversation with host Michael Cowen, Mike reflects on the personal habits (meditating on a spiked mat) and professional strategies (doing small disciplines over time) that have contributed to his success. Tune in to learn his equation for excellence, recipe for losing your life, and daily routines. They’ve taken years to develop, “but now, I’m cooking with gas, and that is what it takes.”

They also share how they successfully minimized comparative fault, and how they presented damages in a way that made an emotional impact.
