COW COUNTRY NEWS USDA Finalizes Voluntary “Product Of USA” Labeling Rule USDA Secretary Tom Vilsack on Monday announced the finalization of a rule to align the voluntary “Product of the USA” label claim with consumer expectations of what the claim means. The designation allows the voluntary “Product of USA” or “Made in the USA” label claim to be used on meat, poultry and egg products only when they come from animals born, raised, slaughtered and processed in the United States. The final rule aims to prohibit misleading U.S. origin labeling in the marketplace and helps ensure that the information that consumers receive about where their food comes from is based on facts. The labels will continue to maintain their voluntary status for use on products and also will be eligible for generic label approval, which removes the need for pre-approval by USDA, but requires manufacturers to maintain documentation to support the claim. Last summer, the country of origin labeling rules (COOL), as they were proposed, covering meat, poultry and egg products, were criticized by the Canadian government and the National Pork Producers Council because they included specific regulations on where the animals were raised, which were not part of earlier versions of the rule. Companies that use the “Made in the USA” claim will need to comply with the final rule by Jan. 1, 2026, but are being encouraged to do so as soon as possible. The National Cattlemen’s Beef Association’s Executive Director of Government Affairs Kent Bacus released the following statement on the USDA's finalized rule on the "Product of USA" label by saying, “NCBA has been committed to finding solutions to this problem ever since a producer-led NCBA working group raised the alarm, years ago, that imported beef could be mislabeled as a Product of the USA incorrectly at the end of the supply chain. We appreciate USDA’s effort to address this loophole. Cattle & Agriculture Industry News Former USDA Counsel Named Deputy Ag SecretaryA veteran of the first Trump administration's agriculture team has been named to be deputy secretary of the USDA. President-elect Donald Trump announced his nomination of Stephen Vaden to be deputy under Brooke Rollins, a former think tank executive already tapped to head the USDA. A Yale law graduate, Vaden served as USDA general counsel from 2018-2020, when he was confirmed to a judicial appointment on the U.S. Court of International Trade. He has served as a board member of the Commodity Credit Corp. CDC Confirms Nations First Severe H5N1 Infection Of HumanA patient in Louisiana was hospitalized with a severe case of avian influenza (H5N1), marking the first instance in the United States of severe illness linked to the virus, the Centers for Disease Control and Prevention (CDC) announced today in a news release and press call. CDC said the Louisiana patient, one of 61 human cases to occur in the United States since April, was infected with a D1.1 virus recently detected in wild birds and poultry in the U.S. and in recent human cases in British Columbia, Canada, and in the state of Washington. Officials noted the D1.1 strain of H5N1 is different from the B3.13 genotype detected in dairy cows, sporadic human cases in multiple states, and some poultry outbreaks in the U.S. No person-to-person spread of H5 bird flu has been detected. California State Of Emergency, New Human Infections, Canadian Struggles all due to H5N1Gov. Gavin Newsom issued a state of emergency in an effort to streamline the Golden State’s response to highly pathogenic avian influenza (HPAI). Several California agencies have developed coordinated responses to address and minimize farm worker exposures, lower raw dairy product contamination and mitigate the spread of the virus, the governor said in a statement: He said “This proclamation is a targeted action to ensure government agencies have the resources and flexibility they need to respond quickly to this outbreak.” About 680 dairy farms are under quarantine from HPAI outbreaks, while 6.2 million birds have been hit and 36 people infected across California. A commercial poultry worker in northwest Iowa is now the first confirmed human case of HPAI in the Hawkeye State, according to the Iowa Department of Health and Human Services (Iowa HHS). An estimated 6.7 million birds have been affected in more than a dozen counties across Iowa, according to USDA’s Animal and Plant Health Inspection Service (APHIS). The Canadian Food Inspection Agency (CFIA) announced that more than 13.9 million birds have been impacted by HPAI in the most recent tally of the spread of H5N1 infections across nine provinces. British Columbia is reporting the highest number of HPAI cases among 8.3 million birds. New Brunswick has the lowest number of birds affected by avian influenza with fewer than 100 birds at two locations being confirmed with the virus. Beef Processor Fined For Odor ViolationsThe Texas Commission on Environmental Quality (TCEQ) fined STX Beef Company $200,000 for violations linked to foul odors coming from its Corpus Christi facility, according to a local report. The penalty follows years of complaints about smells traced to cattle processing and wastewater management issues. TCEQ also cited equipment failures, inadequate scrubber systems and poor recordkeeping. Of the fine, $2,000 is already paid, with $40,000 due soon. Over $80,000 will support Texas A&M University-Corpus Christi’s AutoCheck program, addressing regional vehicle emissions. The company has 30 days to submit an odor control plan, including equipment repairs and new systems, and must comply with air quality rules for five years. Corporate Transparency Act Reporting Requirement Will Return Due to Court RulingProducers pay attention now. The Corporate Transparency Act filing requirements are back in effect following a court decision that reverses the injunction that previously halted this mandate. NCBA Executive Director of Government Affairs Kent Bacus said that The Corporate Transparency Act requires millions of family farmers and ranchers to file complex paperwork and disclose beneficial ownership information with the federal government under penalty of severe fines and jail time. Earlier last week, the Fifth Circuit Court of Appeals lifted a nationwide preliminary injunction on the enforcement of the Corporate Transparency Act, holding that the government is likely to prevail in a constitutional challenge. This decision places many small businesses in jeopardy that have not yet filed Beneficial Ownership Information with the Financial Crimes Enforcement Network (FinCEN), a division of the U.S. Department of the Treasury. In light of the Fifth Circuit’s decision, FinCEN announced it will delay enforcement of the Corporate Transparency Act until January 13, 2025. Whose job is it to change the cattle industry. Is it the cow-calf man, who raises the majority of the beef? Is it the seedstock producer who raises the genetics that we need? Is it the stocker, who gets the calves on feed? Is it the feed yard to get the cattle to finish? Is it the packer who processes and harvests the beef? In reality, it is all of these segments coming together to make the changes we need in the cattle business. However, it is the seedstock producer who can influence that change probably more than any of those aforementioned segments. We had a great sit-down conversation with Steve Koester, the immediate past president of the Red Angus Association of America and Co-Owner and Manager of Koester Red Angus. KOESTER RED ANGUSOur vision for the future...Rooted in heritage and stewardship while envisioning tomorrow. We look beyond the current season and market, seeking fresh genetics that will add value to our customers’ calves and cowherds for generations into the future. We know – and accept the responsibility – that our decisions today impact the livelihood of the cattlemen who trust our genetics. All of our registered Red Angus Cows and heifers calve in August and September on pasture, where we weigh and tag daily. We also udder and disposition score each dam as she calves. All of our cows are DNA tested and display genomically enhanced EPDs which predicts their potential to the highest level possible. In early November, we synchronize, AI and sort into breeding groups for a 45-day breeding season. Matings are done which enhance our customers’ profitability to the best of our ability. We wean calves in March and collect DNA samples for GGP testing. We also weigh and body condition score the cows as well as record her foot scores. The heifers are summered on pasture with only protein block supplements. We run the bulls on grass with just enough supplement to maintain their development and prepare them for yearling carcass and data collection. They are not put on a feed test. The Sale Bulls come into the lot in late August where we develop them as long yearlings for the sale in March, held in conjunction with Leland Red Angus at their ranch near Sidney, Montana. In addition to genomically enhanced EPDs on the Sale Bulls, we continually monitor performance, feet, and disposition, culling accordingly until only the highest profitability bulls are maintained for sale. Season 5, EPISODE 227 Animal Health & Disease Management: Should We Be Concerned & Tariff Updates Improving Animal & Disease Management Practices: Foot & Mouth Disease, and Tariff News Foot & Mouth Disease: In LivestockFoot-and-mouth disease (FMD) is a severe, fast-spreading viral disease that primarily affects cloven-hoofed animals, including cows, pigs, sheep, goats, and deer. FMD is one of the most challenging animal diseases to control. Although most infected animals survive, they're left weak and unable to produce the level of meat and milk prior to infection. FMD was first discovered in the United States in 1870 and eradicated in 1929. FMD is not a human health or food safety threat. The disease is not related to hand, foot, and mouth disease, a common childhood illness caused by a different virus. How To Identify Foot & Mouth DiseaseThere are 7 known types and more than 60 subtypes of the FMD virus, meaning immunity to one type doesn't protect animals against other types or subtypes. The first signs of illness usually appear within 2 to 14 days after infection. Here's what to look for:
FMD Can Easily Be Confused With Other Diseases FMD may be confused with other diseases that produce blisters, including vesicular stomatitis, bluetongue, bovine viral diarrhea, foot rot in cattle, and swine vesicular disease. The only way to tell if the blisters are caused by the FMD virus is through laboratory testing. If you observe mouth or feet blisters in your animals, report them immediately so that they can be tested. How To Prevent Foot & Mouth Disease
Because FMD occurs in many parts of the world, there's always a chance it could be reintroduced into the United States. APHIS continuously monitors FMD worldwide. Our veterinarians stationed overseas help other countries control and eradicate the disease, which reduces the risk of it spreading to the United States. At ports of entry, we work with the U.S. Department of Homeland Security’s Customs and Border Protection to screen cargo and prevent travelers from bringing any products of concern into the United States. We restrict or prohibit imports of many animals and animal byproducts from areas known to be affected with FMD. We also work with the U.S. Armed Forces to make sure military vehicles and equipment are properly cleaned and disinfected before they return to the United States from international duty. Across the country, APHIS and other Federal, State, and Tribal animal health officials work with accredited veterinarians to monitor domestic livestock for FMD. We have response plans in place that we can quickly activate if the disease is found in the United States. Click HERE for additional details. Tariffs: China Targets U.S Agriculture For Retaliation of 20%The United States plans to impose a 20% tariff on Chinese goods, could result in a significant escalation in trade tensions between the two economic giants. In response, China is reportedly preparing countermeasures that could directly impact U.S. agriculture and food exports. According to The Global Times, the official newspaper of the Chinese Communist Party, Beijing "will definitely carry out strong, powerful countermeasures" if the U.S. increases the current 10% tariff. The report indicates that American agricultural products, including beef and pork, are "most likely" to be targeted with new tariffs. The trade uncertainty is already shaking U.S. agricultural markets. Hog futures have dropped 6% in recent trading sessions, according to the Daily Livestock Report (DLR). China and Hong Kong together account for 19% of U.S. beef exports and 6.5% of pork exports—significant figures that highlight the stakes of these trade tensions. As it stands, China has already imposed a 37% tariff on U.S. pork and a 12% tariff on U.S. beef, making American meat exports less competitive in the Chinese market. A further escalation could worsen the situation for U.S. farmers and ranchers. With agriculture facing potential economic strain, U.S. Secretary of Agriculture Rollins has signaled readiness to implement relief measures. She indicated that a financial aid package similar to the $28 billion bailout deployed during the 2018 trade war under President Trump could be reintroduced. However, reports suggest that only $4 billion remains in the fund earmarked for agricultural assistance in 2025, raising concerns about the adequacy of available support. All eyes are on how China will respond and what further actions the U.S. might take. The agricultural sector, already facing global market challenges, is bracing for potential disruptions. For farmers, ranchers, and agribusinesses, staying informed about trade policy developments is crucial. If China follows through with its threats, the impact could be widespread across U.S. agriculture, affecting prices, exports, and overall farm profitability. Canada and Mexico are also in the cross hairs of trade tariffs with both countries promising immediate retaliatory responses. While there are many factors that weigh into creating a treatment regimen, understanding the different classes of antibiotics and how they work is important to ensure your cattle are getting the best treatment response.
A variety of infectious diseases can compromise cattle health, affecting growth, performance and operational profitability. Bovine Respiratory Disease (BRD) is one of the most common and costly. Prevention is the first line of defense against BRD. Having management protocols in place to reduce risk factors, along with a vaccine program, can help protect your herd. Latest Beef Industry News Vet Says Beef Producers Must Step Up With H5 TestingA leading scientist and veterinarian, Kay Russo, warns the beef industry to start monitoring for H5 bird flu crossover from infected dairy herds. Speaking on the MeetingPod podcast, Russo noted that while the virus was first detected in dairy cattle in March and has since impacted poultry farms and workers, there's limited data on beef cattle. Russo, with a DVM from Cornell and a master’s in avian health from the University of Georgia, emphasized the importance of testing beef cattle for antibodies now that a validated test exists. Canadian Herd To Stabilize In 2025The Canadian cattle herd is forecast to sustain the long-term trend of contraction to begin 2025 but will begin to stabilize by year’s end on improved feed pricing and availability. A smaller calf crop will be produced based on 2024 breeding stock but heifer retention should improve if feed conditions continue to remain stable or improve. Higher heifer retention coupled with a smaller calf crop will see lowered beef production and slaughter in 2025. U.S. Beef Imports Up 21% in 2024Through August 2024, U.S. beef imports saw a notable increase of 20.87%, rising from 2.51 billion pounds in 2023 to 3.03 billion pounds in 2024. Among the top contributing countries, Canada remained the largest supplier with 658.83 million pounds, a 3.18% increase from last year. Australia showed the most significant growth, with imports surging by 69.95%, reaching 635.69 million pounds, making it the second-largest beef exporter to the U.S. after Canada. Brazil also experienced a sharp increase of 41.89%, with imports growing to 496.21 million pounds. On the other hand, Mexico saw a decrease of 15.54%, with imports dropping to 386.07 million pounds. Uruguay recorded the highest percentage growth among all countries, with imports increasing by 71.46% to 198.20 million pounds. New Zealand and Nicaragua also contributed to U.S. beef imports, with increases of 8.75% and 1.76%, respectively. This growth in imports reflects increased global beef supply, with particular strength from regions like Australia and Uruguay, offsetting declines from Mexico. Appeals Court Decides Whether Tyson Owes Ghost Cattle Operator A federal appeals court sided with a Washington district court’s ruling that Tyson Fresh Meats did not owe Cody Allen Easterday any money for alleged breach-of-contract claims. Easterday is currently serving a 11-year prison sentence for defrauding the company of $244 million in a ghost cattle scheme. Companies related to his operation had repaid at least $63 million to Tyson as of February 2023.
He claimed Tyson owed him approximately $100 million for using his likeness on meat product labels in Japan. USDA Says Hog Had Wild H5N1, Utah Reports First Dairy Outbreak The avian flu found in a backyard hog in Oregon appears to be a strain of H5N1 contracted directly from wild birds, rather than the strain that crosses over from birds to dairy cattle, according to top USDA officials. Meanwhile, Utah has confirmed its first outbreak in dairy cattle, with infections discovered on eight farms in Cache County. The appearance followed the culling in early October of the entire flock of 1.8 million chickens after the virus was discovered on a Utah poultry facility for the first time since 2022. One-third of the cow’s ownership was sold to Nelore HRO at Brazil’s Agropecuária Casa Branca. The price tag for the partial ownership— $1.44 million dollars. Back in 2022, half of the ownership for the same cow broke a record with a $800,000 dollar price tag. With the most recent purchase, the total worth of Viatina-19 FIV Mara Imóveis is now valued at $4.3 million dollars. EMBEDDED NELORE CATTLE The Nelore origins date back over 2000 years when the Aryan people brought the ancestors of this breed to India. These ancestors were called Ongole, the change of name to Nelore (which corresponds to a district of the old Presidency of Madrás, now belonging to the new State of Andra, by the Bengal Sea) happened in Brazil by some authors as a synonym to Ongole.
This breed, through its history has faced extreme weather conditions, the arid lands of Belushistan, the cold winters of Punjab, the alluvial lands of the Ganges and the torrid lands by the Bengal sea. This provided the Ongole breed with the adaptation genes that are now favourably expressed in the modern Nelore.
The Nelore was first acknowledged in Brazil in 1868, when a ship on its way to England carrying two Ongoles stopped in Salvador, Bahia, and the animals were sold. Ten years later, a breeder from Rio de Janeiro, named Manoel Ubelhart Lemgruber, bought another couple from the Hamburg Zoo in Germany. Then the Nelore breed expanded gradually, first in Rio de Janeiro and Bahia, then in Minas Gerais, having reached Uberaba in 1875.
The creation of the Nelore Herd Book and the definition of the breed standards in Uberaba, 1938, was of great relevance in the formation of the Nelore. In 1960, 20 animals were imported, and in 1962, the last and most relevant purchase of live animals from India authorised by the Brazilian Government, 84 Ongoles were imported. These became founders of important breeding lines like Godahvari, Karvadi and Taj Mahal, and were decisive to the great expansion of the Brazilian herd in the last 30 years, going from 56 million in 1965 to 160 million in 1995, 100 million of which are Nelore.
Today, the number of purebred registered Nelore is above 5 million. The challenge faced by selection is to multiply the genetic gains to a much larger population. To multiply the genetic potential of Nelore sires, Artificial Insemination has been used in large scale since the 60’s. Sales of Nelore semen represent 65% of the AI market of all beef breeds in Brazil. The leading Nelore sire there produced and sold 34,000 straws of semen in 1995, followed by another Nelore that sold 30,000, which means that both sires must have bred more than 20,000 cows.
The Nelore is of the Bos indicus species and has the characteristic hump above its shoulders and loose skin. It is usually white in colour with a black skin, muzzle and tail, and they have comparatively long legs which helped them walk in water when grazing. Nelore have the shortest ears of most Bos indicus types. The Nelore are horned, these are thick brown horns that point up but there is a naturally polled strain of the breed too.
The Nelore has heat and insect resistance due to its loose, thick black skin and covering of white hair which reflects the sun's rays, this breed has sweat glands that are twice as big and 30% more numerous compared to European breeds. It has a slow metabolism which creates less heat and enables it to feed less often adding to its high resistance to bloat.

EPISODE 165 DETAILS So many of you have reached out inquiring about the latest details about the Agridime Cattle Ponzi Scheme. It gets rather complicated, but BEC and I break it down for you. Some of the most feed efficient cows around are coming up for sale. Lucky 7 Angus Ranch is selling their spring calving Oklahoma cows at public auction, January 8th at Ogallala Livestock Auction in Ogallala, Nebraska. AGRIDIME According to articles in the Bismarck Tribune and Ag Week, the U.S. Securities and Exchange Commission, which filed a civil lawsuit against the company on Dec. 11, has labeled the operation a Ponzi scheme, in which Agridime was using investor money to pay existing investors and commissions to salespeople rather than using new money to do what it said it would — purchase, feed and care for cattle to be finished and sold to consumers as beef. The SEC has received a temporary restraining order, including an asset freeze, on the company owned by Joshua Link of Arizona and Jed Wood of Texas, through Jan. 9, pending a hearing on Jan. 5. As of Sept. 5, 2023, Agridime-held cattle contracts required payment to investors of $123 million in principal, plus $24 million in guaranteed "profits." The company, as of Sept. 30, 2023, had less than $1.5 million and insufficient operating revenues, the SEC complaint said. Carl Karpinski, enforcement attorney for the North Dakota Securities Department, said there is no confirmed tally yet on investment losses in North Dakota. But he said the eventual number may be significant. "North Dakota is one of the most — if not the most — affected states" in the nation, he said. While the SEC complaint did not go into specifics about the cattle the company did purchase, other than specifying that "Defendants did not buy the number of cattle required to fulfill the Company's obligations under the Cattle Contracts," Agridime was licensed as a livestock agent in North Dakota. Agriculture Commissioner Doug Goehring announced on Dec. 15 that it no longer will be licensed in the state. “Agridime was licensed in North Dakota,” Goehring said in a statement. “Their renewal was pending based on issues with bonding. The actions taken by the SEC will support our denial of their license and we will issue a cease-and-desist order, effective (Dec. 15), to prevent further purchase of livestock.” Karpinski said the Securities Department is not working on the cattle sales side of the case, though the North Dakota Department of Agriculture and U.S. Department of Agriculture are involved. Ellingson encouraged producers involved in the case to contact the Stockmen's Association at 701-223-2522. HOW AGRIDIME OPERATED The SEC complaint said Agridime raised $191 million from more than 2,100 investors in at least 15 states since January 2021. Instead of using investor money as advertised, the SEC filing said Agridime has used at least $58 million from Dec. 1, 2022, to Sept. 30, 2023, in investor funds from new cattle contracts to make principal and profit payments to previous investors. Agridime would sell investors cattle contracts for $2,000 per calf. The company would then promise to buy the cattle back a year later at return rates of 15% to 32%, the complaint says. Agridime paid commissions to salespeople, typically 10%, for each cattle contract sold, which also was not disclosed to investors. The SEC documents say that through May 2023, commissions paid exceeded $11.1 million in total, including "at least $5.6 million to a salesperson in North Dakota," $1.3 million to Link and his wife and $1.3 million to Wood. By using the funds to make previous investor payments and to pay commissions, "Agridime has not purchased enough cattle to fulfill its Cattle Contracts. Agridime's investors, therefore, do not actually invest in specific, identifiable animals. Instead, the success of their investments depends on the success of Agridime's purported cattle operation, including its ability to attract new investors." Agridime had operations in Texas, Arizona, Kansas, North Dakota and "other states," court documents said. In North Dakota, Securities Commissioner Karen Tyler on May 24, 2023, ordered a cease and desist order against Agridime and Link. Neither Agridime nor Link were registered as an issue-dealer or a broker-dealer in North Dakota, the cease and desist order said. Despite that, Link on Sept. 7, 2022, sold an investment contract to a North Dakota resident for $250,000, the order said. The SEC complaint said Agridime sold $9 million in 18 cattle contracts to North Dakota residents since the issuance of the cease and desist order in May. Agridime also sold $1 million in cattle contracts to Arizona residents since a similar order was issued there on April 18, 2023, and an Agridime salesman there admitted under oath on Oct. 18 that he still was selling contracts in Arizona. The state of Arizona in November filed a contempt motion against Agridime and Link. Tyler issued another cease and desist order in North Dakota on Dec. 15 against Taylor Bang of Killdeer, which alleged that Bang, despite not being registered as an agent with the Securities Department, had received $6,055,390 in "transaction based commissions by selling unregistered cattle investment contracts on behalf of Agridime in or from North Dakota" from Jan. 1, 2021, through Oct. 30, 2023. Under North Dakota law, the North Dakota Securities Commissioner can assess civil penalties of $10,000 per violation of the Securities Act. Bang said he’s always approached his business honestly and was simply taking direction from Agridime. “I was just doing a job.” Bang disputes the claim that he made more than $6 million in commissions from Agridime. He said that figure is “way high” and that he wasn’t sure how the Securities Department arrived at that number. The Securities Department says it calculated the figure from subpoenaed financial records. Bang said he was aware of the May cease-and-desist order the North Dakota Securities Department filed against Agridime and Link, but that as far as he could tell, the company took the legal demands outlined in the orders seriously and was working to address them. The rancher said he’s worked with Agridime for roughly seven or eight years. He said he still thinks very highly of the company and is proud to support the American livestock industry. “To date, I have not had one person that has done this, as far as the cattle-purchasing contracts, not get paid on time,” Bang said. In the Dec. 15 order, Tyler ordered Bang to turn over all commissions received from Agridime, to be deposited into the North Dakota Investor Restitution Fund and to be liable along with Agridime to Agridime investors. AMERICAN FARMERS NETWORK TO SET CRITERIA FOR RE-GEN, GRASS-FED BEEF.
American Farmers Network (AFN) announced it is spearheading the establishment of comprehensive certification criteria for regenerative grass-fed beef production. With USDA approval to use the Regenerative Agriculture claim on its packaging, AFN said it aims to set industry standards across the beef category, the organization said in a release.
AFN's said its partnership with certifying organizations aims to create transparent standards for the beef industry, aligning with regenerative agriculture principles of soil health and animal welfare. AFN plans to work with retailers and partners to make regeneratively raised beef accessible nationwide.
By providing incentives to producers to adopt regenerative practices, AFN seeks to cultivate a more sustainable agricultural landscape.
The certification criteria will cover grazing management, soil health, animal welfare and social responsibility, the company said. Ranches meeting these standards will earn formal certification, distinguishing their products as sustainable and ethical choices in the marketplace. LIVESTOCK INVENTORY DECLINE HURTING COLD STORAGE NUMBERS. The USDA's March Cold Storage report revealed declines in red meat and poultry supplies for 2024. Analysis from Market Intel detailed how the declining livestock inventories are impacting the cold storage numbers. Red meat in freezers decreased by 4% from February 2023, hitting a 23-year low at 1.05 billion pounds, while frozen poultry stocks remained stable at 1.03 billion pounds. The March Cattle on Feed report showed a 1% increase in cattle on feed compared to 2023, indicating continued liquidation in the U.S. cattle industry, possibly impacting beef prices.
