FERAL HORSES in AZ an ongoing dilemma with Johnatan Fusaro WHY ARE THE ARIZONA SPORTSMEN FOR WILDLIFE CONSERVATION, THE CENTER FOR BIOLOGICAL DIVERSITY AND 32 SPORTSMEN ORGANIZATIONS REQUESTING THE HUMANE REMOVAL OF FERAL HORSES?

In 2011, The Wallow fire consumed vast portions of the Apache National Forest. It also destroyed parts of the White Mountain Apache Tribal lands (WMAT). With the fire, the boundary fences between the WMAT and the Apache National Forest were destroyed.  During the next 11 years, horses from the WMAT came over to the Apache National Forest and migrated to the portions of the riparian areas that are home to the New Mexico Meadow Jumping Mouse and a recovery area for the Apache trout.

The photos that have been provided were taken by Dr. Robin Silver from the Center For Biological Diversity during 2019 and 2021. He documented that over 80% of the tracks and droppings were from horses.  While horse advocates may try to claim that the horses were there for centuries, the truth is that they have migrated from tribal lands since the Wallow fire to the forest and need to be removed.

During extensive studies for the Wild Horse and Burro act in 1971 and 1973, there was no evidence of wild / feral horses on the Apache National Forest. The feral horses are growing in numbers each year and the head count exceeds over 400 animals.  The habitat degradation that they have caused is severe and removal is the only means of rebuilding these areas for all wildlife.

Show Notes:

One of our bill researchers and content writers, Travis Halls, joins me for our Action Center Review. He has hands-on experience with some of the bills we’re working on in our action center. Bill season is typically January through April, but it’s mid-June and there’s still a lot going on. Travis gives us a rundown on the expansion of bear hunting in the western part of North Carolina. The commission decided that since the population is expanding, they opened up more areas, even in what were known as “sanctuaries” and off-limits. This ruffled some feathers within animal rights groups.

 

We then get into Utah’s “Houses Act”, which was introduced to the Senate in April. The bill was put forth to propose to take some federally managed land and free it up for purchase from state and local municipalities. It would make the land affordable, which would then sell to developers for housing. If the bill goes through, it will pose a risk for wildlife habitation. This isn’t just a Utah thing, and it’s happening in other areas. 

 

Speaking of land use issues, in New Jersey, there’s a bill currently in the NJ house that takes an existing buffer zone from 150 yards from a residential area to 400 yards. It also requires private landowners to inform adjacent landowners of their intent to hunt. Before you can start hunting, you’d have to receive some sort of acknowledgement from your neighbors. We talk about how this kind of rule impacts the hunting community.

 

Another current topic is the lead ammo ban in New York State. While banning lead bullets seems like a good idea, it can discourage people from hunting. Lead is a lot cheaper than ammo like copper. Travis and I close out with a discussion on what’s going on in Washington with elk and lion.

Take 5 minutes to lead, take action and help the hunting community!

Jess Johnson with the Wyoming Wildlife Federation maps out the status of legislation being developed, and the need for hunting community engagement and support NOW. This is an opportunity to lead and help establish better laws that continue to support and favor hunting and trapping, while penalizing and deterring truly unacceptable behavior. 

Background: the Daniel, WY "wolf cruelty incident" has spurred a national outcry for laws that have more teeth int them... This demand included a coalition of 1000s of hunters and 70+ hunting industry organizations.

Legislative Next Steps: in early October the Travel, Recreation, Wildlife and Cultural Resources Committee will review and update proposed legislation that comes out of a "Predator Mgmt Working Group/SubCommittee". 

Current Need for Legislation Improvements: the legislative process is often messy and the proposed law here is not fully baked, so we as hunters can steer it towards a better statute and more likely success on the way to the WY Governor's desk. 

- email the committee leadership: Chairwoman, Senator Wendy Schuler and Chairwoman (Wendy.Schuler@wyoleg.gov ) , Representative Sandy Newsome ( Sandy.Newsome@wyoleg.gov )

- Identify yourself as a hunter who values wildlife, fair chase and the need for simple, successful and effective legislation 

- Request that the proposed "Cruelty to Wildlife" legislation be amended to (1) remove all mention of motorized and over-snow vehicles to simplify and focus the legislation and (2) move the new law into Title 23 (wildlife laws) for better implementation and to maintain its legal relationship to wildlife while eliminating potential complications involving hunting and trapping.

Even as the Covid-19 outbreak drove more people into America's forests, waterways, and shooting ranges, the support for hunting, fishing, trapping, and recreational shooting has declined over the past three years, according to a recent poll of Americans' sentiments toward these activities. After almost 30 years of rising public support, there has been a decline in support for legal field sports. This decline may be due to a broader and growing distaste for activities that are mostly associated with older, white, rural men.  Or It may mean we are not doing a good enough job speaking to the non-hunting public . Responsive Management conducted a poll titled "Americans' Attitudes Toward Legal, Regulated Fishing, Target/Sport Shooting, Hunting, and Trapping," which was published June of 2023. The Outdoor Stewards of Conservation Foundation, a think tank that focuses on disseminating information on outdoor trends procure a grant to get this study done. Jim Curcuruto sits with John Stallone and discusses this study and what are the take aways and possible solutions.

Bottom line is that bad optics and complete lack of context has some folks at the F&G Commission thinking that coyote (nongame species) need special regulations developed for hunting.  Whooaaaaa nooooo they do not. Not when we have limited resources, limited time, limited staff and there's huge pressing issues such as bear, deer, elk, bobcat and wolf management plan updates!

It is becoming more & more apparent that a majority of the current WA state F&W Commission has a bias against hunters, and hunting. The threats are directed at bear and cougar hunting, with indirect impacts which will be felt across all species in Washington and likely will impact hunters and wildlife nationwide. The threats here are perpetrated by the same anti-hunting industry players we see in Colorado, California, Arizona, etc.

A herd of bighorn sheep could soon lose access to its historic winter range if a controversial housing development is allowed to go through in the town of Vail, Colorado. 

The high density housing complex that’s threatening these Colorado big horns is being proposed by Vail Resorts—a multinational corporation that owns and operates 40 resorts in the U.S., Australia, and Canada. 

Vail Resorts is hoping to build multiple structures in the middle of critical sheep habitat to house its growing workforce. That would amount to a total of 61 residential units on a parcel that the company owns known as Booth Heights. This plot sits between I-70 and the Gore Range, and it has served as critical winter grazing ground for the native Gore Range bighorns for as long as most Vail residents can remember. 

The corporation says that this housing project is vital to its long term goals and has ignored pleas from Vail community members and the Vail Town Council to build the development on a different parcel that won’t threaten critical wild sheep habitat. 

Habitat loss and fragmentation of bighorn sheep herds pose significant threats to this already imperiled species, and Vail Resorts’ plan to build on this historic sheep winter range would directly contribute to that troubling trend by forever displacing Vail’s beloved bighorns. 

After completing a thorough on-the-ground study of the proposed development site, the Colorado Department of Parks and Wildlife’s own biologists advised Vail Resorts against moving forward with this project. They say, in no uncertain terms, that “the impacts to this already struggling sheep herd as a result of this development might not be able to be mitigated.” Translation: the habitat will be lost and the sheep will be gone.  

As previously mentioned, Vail Resorts has chosen to disregard these grave caveats as well the groundswell of local opposition that has emerged within the Vail community. 

Vail Resorts has been given multiple generous alternatives by the Town of Vail to move their development to another location (free of charge) and the ski company has denied all of those offers. 

Additionally, Vail Resorts boldly claims to have a “Net Zero impact on the environment and habitat”. These empty claims are proving to be nothing more than greenwashing, and a ploy to attract investors. 

Please help the Town of Vail and the continued existence of this iconic wild sheep herd by taking action on behalf of bighorns below.

Nearly 150 MILLION Americans live within 2 hours of an ocean... so the concept of "hunting the coastal waters" is something that we all need to be aware of and support. Just like hunting, angling opportunity is part of the basic human experience, and as a community we need to be concerned about habitat quality, access and opportunity. 

Nearly 1200 pages of petitions have recently been submitted to the Calif. F&G Commission, most of them attempting to severely limit your opportunity to "hunt coastal waters" in California. Just like protecting the mtn lion hunt in Colorado, we need to become informed, and rally to support angling opportunity when it is arbitrarily threatened.

The “Return Act” GUTS Wildlife Conservation and Hunting

Initially I wanted to write a very sophisticated and technical account of the situation. However, I have decided to give you a layman’s view of the bill and the implications.  Rep. Andrew Clyde (R-Ga.) has introduced H.R. 8167 a bill that would ultimately be the tumbling pebble that initiated the collapse of the hunting industry. This is a bold and polarizing statement, but unfortunately very true. This bill aims to remove Pittman Robertson (PR) Excise tax from the sale of firearms, ammo and sporting equipment. Don’t know what PR is or does? Simply put, PR is an 11% excise tax to the manufacturers of firearms, ammunition, and archery equipment .  The proceeds of the funding is distributed to state governments for wildlife restoration projects, public shooting ranges, hunter education programs and R3 programs.  

How will this destroy hunting?

  1. Anti-wildlife:  Removing a key component of wildlife conservation funding will ultimately result in less sustainable populations of wild animals, both game and non-game species. Less game, means less opportunity, less opportunity means less participation, less participation means less funding, and less funding means even more loss of wildlife. The all mighty dollar is always the number one contributing factor on policy creation, especially when it’s on a resource that is determined by perceived value. Deer have value to people who want to see them on the landscape, but how much are they willing to pay to see them there? Deer also have value to those who want to hunt them and consume them. Historically hunters are willing to pay much more 20-30x more than wildlife viewers for animals to be on the landscape. Removing, funding just shrinks the hunters voice and adds more road blocks for sound management practices which ultimately will end up hurting wildlife.  
  • Removes a piece of our armor:   One of the most relatable arguments we have as stakeholders in wildlife management and hunting legislation is the funding we bring to the conservation table. It has been very hard for special interest groups and anti-hunting groups to out voice us because we have been protected by the shield of conservation funding. Although PR funds are just a portion of the funding provided by hunters, it is still a very substantial component to wildlife management funding and without question fortifies our right to have a say in what happens in wildlife management. Plus as in the aforementioned example #1, the alternate funding streams would begin to follow suit in a domino effect further stifling the voice of the hunter.
  • Pitman Robertson protects Hunting: PR funds work on a fund matching base. Many states do not have laws that protect funding from license and tag sales from being used by the state for other projects. The way PR works – To help ensure states use the money for wildlife conservation, habitat , shooting facilities, hunter Ed and R3 programs, each state will receive (roughly) $3 for every $1 they generate for these programs. This is an incentive for state fish and game agencies to keep and use as much of their license sales and even create other revenue streams IE: raffles and auctions etc. to receive more funding from PR. If this mechanism is lost, it is very likely that much of the funding brought in by license and tag sales would be pillaged by the state for projects unrelated to wildlife conservation. I don’t have to state what that would do to our wildlife and hunting opportunity.  

 Cutting off their noses to spite their face!

  1. This bill is likely a political stunt to retaliate to the absurd 1000% tax law introduced by Rep. Don Beyer of Virginia and many of the other anti-gun laws surfacing in the current political climate. Many Republicans have supported this bill touting their 2A membership cards and rallying the “troops” not realizing that pushing this bill forward would be detrimental to the gun industry. According to “American gun facts” 81 million Americans own guns, there are 15-17 million hunters in the US alone so roughly 20% of gun owners are hunters. In order to make an example of anti-gun policy supporters of this bill are willing to punish 20% of their constituency. What happens when hunters can’t hunt anymore and don’t have a need for their firearms or more ammo?
  2. The fertilizer that cultivates 2A: What the supporters of this bill fail to recognize is that PR funds are a main driver for the cultivation of shooting sports. A portion of PR funds are ear marked for public shooting facilities, and youth programs. This not only brings new gun owners into the community but it gives gun owners a place to exercise their right of gun ownership. PR funding is directly tied to the hunting community and hunting conservation, the manufactures of firearms and ammunition recognize and support it because they know that hunting provides an avenue to again exercise the right to owning a firearm. Without these avenues those guns become pieces of furniture in one’s home. What good is a gun in my safe that I can’t go use anywhere?
  3. Stop the tyranny “I intend to stop the Left’s tyranny in its tracks by eliminating the federal excise tax on firearms and ammunition” Rep. Andrew Clyde (R-Ga.) The Pittman Robertson act was initiated by sportsmen and women and more importantly the gun and ammo manufactures to ensure wildlife and the hunting heritage go on for perpetuity. It wasn’t introduced by some leftist tyrant looking to punish gun owners. By undoing this legacy Act those who support it are becoming what they claim to be fighting against. To representative Clyde’s point, his goal to prevent taxing people out of their rights is without question important. However, this bill is not the answer in fact it may have the reverse affect. Without low cost public ranges gun owners would be forced to use private ranges, which cost more. As demand for these facilities go up the cost will increase. Moreover, if hunting goes away or becomes privatize like in other countries, gun manufactures would be losing a large portion of the hunting community as consumers. Causing revenue to go down which ultimately if you have any concept of economics, will cause the price of firearms and ammo to rise. So who is pricing the “average Joe” out of their 2A rights?      
  4. Blood in the water: The very same groups that this bill boasts to oppose are the biggest benefactors. Anti-hunting groups have recognized the opportunity to jump on board with this bill knowing the damage it would do to the hunter. What happens when you have 2A advocates and anti-hunting groups fighting for the same thing? You guessed it! The demise of hunting as we know it.
  5. The price won’t change: After speaking with two manufactures of ammunitions and firearms both indicated that pricing to the consumer would likely not be affected. When you purchase a firearm for a $100 at the gun store you do not pay $111 plus sales tax for this firearm you pay $100 plus sales tax. The excise tax was paid for by the manufacture. Yes the cost was passed along to you the consumer because it was built into the cost of the gun. Us gun owners have been paying this additional cost since 1937 it is not a tax we see or even perceive. Based on my interview with the two different manufactures if the tax goes away the cost of guns and ammo mostly like won’t come down 11% you are still going to be paying the same price you have always paid. So who wins here? Guess who loses? Wildlife, hunters and every gun owner in America.  

To Rep Clyde's credit his bill does try to provide an alternate funding mechanism for PR through oil and mineral programs, but at an almost 50% discount to the current level of funding, which is bad enough by itself. His proposed solution also stipulates the funding would go to "those of greatest need", which means elk, turkey, deer, antelope and most animals whom are doing well will not be directly benefitted from this new allocation. Plus, Clyde is basing this funding on an industry that is constantly under fire and depending on who is sitting in the White House dictates the amount of funds generated. Furthermore, this is not the only program that is earmarked to be funded by this industry, in fact it would be last in line.   

Many have dismissed this bill as something that doesn’t have any political traction and that “It won’t go anywhere”. I have seen other seemingly preposterous bills be taking lightly and the sportsman have suffered because of it. There are 50+ sponsors of this bill, do not take it lightly......  It’s is my opinion that we the hunting and fishing community need to stomp it out so fiercely and send a message so loud that this is not an option and never to mess with wildlife or our hunting heritage.  In conclusion nothing good can come out of this bill it doesn’t teach the Tyrants they can’t mess with our rights, It will do irreparable damage to wildlife, it won’t save anyone money, it gives anti-hunters more power, it will be the demise of hunting and ultimately it will eliminate a large portion of gun owners in America which is precisely the converse of the 2A topic.

HOWL for Wildlife welcomes Justin Webb (Executive Director of the Foundation for Wildlife Management) and Jessi Johnson (Government Affairs Director, Wyoming Wildlife Federation.)

Wolves are on the cusp of exponential population growth in California. The known wolf population nearly doubled in California in 2024 and is now reaching past 70 animals, with 9 packs acknowledged and several additional "areas of wolf activity" identified. California could trend towards 300+ wolves in CA by 2027. Wolf numbers may grow faster than management practices and policies can evolve, and a wildlife and ecosystem crisis could be the result. 

This Townhall will be a forum to learn from experts who know their way around wolf issues - including policy and practices of management. This is the beginning of several deep dives into one of the most contentious and complex wildlife issues we have in California, and really throughout North America. 

Our goal at HOWL is to build deeper education into this topic, and broaden support for successful adaptive management which supports both wild and human ecosystems. The wolf management plans for California are nearly 10 years old and need to be updated. Wolf numbers may soon warrant a delisting from "endangered status", or at least down-listing in California. Plan updates and ESA/CESA changes will surely take 1-2 years to complete, during which time the wolf population in CA could grow 3-5x from current numbers. The time to start discussions that lead to plan updates is now.

Bottom line... successful wildlife management and quality conservation systems depend on regulated hunting and science based decisions. The people of Colorado heard our stories, values and the data, and they chose systems that work over emotionally driven lies and rhetoric.

We love Utah... wildly varied topography and habitat, iconic wildlife and legendary hunting opportunities. 

But, in some ways Utah is belligerent and misguided. The current Utah vs. US Federal Govt lawsuit that is being presented to the Supreme Court is a problem.  Here at HOWL we saw the attempt to ban mountain lion hunting in Colorado as something worthy of nationwide attention and engagement... this threat to the Federal public lands system could be 100x bigger, and worse if it succeeds.

Can you love wolves, and still seek to end the forced importation of wolves to CO? Yes.

Wolf "reintroduction" was a charismatic but fictional vision that compelled Colorado voters to narrowly choose to forcibly import wolves from 1000s of miles away. These wolves could not be relocated to Federal land, deep in the National Forests where you might expect. Instead, the relocations landed wolves (with a pre-existing record of preying on livestock) into habitat very close to the heart of Colorado's cattle rangelands.

The result of this voter-approved experiment: social tension, tremendous cost overruns, and wolves, livestock and food producers being treated terribly.

WDFW is taking public comment over the next five weeks on a proposal to allow hunters to take a second mountain lion “in the areas where monitoring has shown a high level of cougar predation on elk calves in the Blue Mountain Elk herd.”

A COUGAR PEERS OUT OF A TREE IN NORTHEAST WASHINGTON. (WDFW)

GPS monitoring of young elk that began last spring show that just nine of 125 made it through this past never-ending winter, with 77 of their deaths attributed to predation, mostly by mountain lions.

The capture-collar effort will be repeated this spring, but it has also sparked calls from hunters and local officials to do something about the problem now.

Under WDFW’s proposal, hunters would be able to tag two of the big cats in what are known as Population Management Units 9, 10 and 11, which encompass Game Management Units 145, 149, 154, 162, 163, 166, 169, 172, 175, 178, 181 and 186.

That’s also the range of the Blue Mountains elk herd, which is classified as “at risk” under a recent population assessment because it has dropped so far below its management objective of 5,500 animals.

The decline began following the killer winter of 2016-17, but despite reduced permits for antlerless cows – the reproductive engine of the herd – numbers are not bouncing back as would be expected, and WDFW is pinning that on cougars, which accounted for 54 of the 77 dead calves. Bears, wolves, coyotes and even bobcats took down the rest.

This year’s aerial survey found 3,600 elk on the range and only 17 calves per 100 cows, well below levels needed to stabilize let alone rebuild this hard-bitten herd.

“This proposed rule is in response to a recent WDFW monitoring effort that showed higher than expected calf mortality attributed to cougar predation in the Blue Mountains,” said Anis Aoude, WDFW Game Division manager, in a press release. “We are seeking your feedback on this proposed rule change.” 

The agency “anticipates a corresponding increase in juvenile elk survival” if the increase is adopted and hunters harvest more cougars, but notes that it does not actually change the season structure in the Blues, where cats can be pursued during the September 1-December 31 general hunt and then from January 1-April 30 under a harvest management guideline that sets out a range of animals that can be taken.

In Population Management Unit 9, the northeastern Blue Mountains and foothills, that number is seven to nine cougars; in PMU 10, the range’s western side, that’s six or seven; and in PMU 11, its rugged southeastern face, it’s five or six. The ranges correspond to 12 to 16 percent of the cougar population.

Only one of the three PMUs – 10 – met the quota before the end of this year’s winter season.

Essentially, the proposal would allow the best cougar hunters to take a second one. A second transport tag would be required. (this is important to understand.  The real issue is there are no effective or efficient methods of take available, such as hunting with hounds, and the mountain lion quota as it stands today is not high enough to be effective for proper balance & management of Washington's wildlife).

The Fish and Wildlife Commission will also hold a public hearing on the proposal at its June 23-25 meeting, and is scheduled to make a final decision July 15.

What the commission does will be interesting.

The citizen panel that oversees WDFW policy has been increasingly loath to address predation, voting twice in the last six months to kill the limited-entry spring black bear hunt for 2022, which with its 158 tags in the Blues could have at least helped disrupt bruin predation on elk neonates during May’s birth pulse.

Last December a former and current member also suggested controversially the solution would be just to lower the elk herd objective and reduce hunting opportunities more.

Anti-hunting tactics have long included “litigate and delay,” directly impacting the lawful harvest of fish and game.  While many of these meritless lawsuits are dismissed, the damage done waiting for injunctions and restraining orders to be released is felt by sportsmen, outfitters, and landowners.  Because of acts like the Equal Access to Justice, these radical and special interest groups can file lawsuits without any regard to financial consequences.

 

The Right to Hunt is for all people.  Events in New Mexico demonstrate the need for all sportsmen from every state to unite behind our common passion, livelihoods, and heritage.  Hunting’s current means and methods cannot be eroded or compromised.  Montanans should not be told when, where, or how they will carry on their hunting heritage, whether on public or private land.

The "4D Rule" is an critically important tool to protecting hunters, anglers and really all public land users from the weaponization of the Endangered Species Act.  Currently a regulatory process related to the ESA listing of the Wolverine seeks YOUR INPUT related to the inclusion of the 4D rule.  What's this mean?? Part 2 of this conversation about threats to marine access that - the anti-hunting philosophy extends all the way from 14,000' granite peaks to deep dark kelp forests ~ and our community is faced with well organized, well funded threats.  

Nearly 150 MILLION Americans live within 2 hours of an ocean... so the concept of "hunting the coastal waters" is something that we all need to be aware of and support. Just like hunting, angling opportunity is part of the basic human experience, and as a community we need to be concerned about habitat quality, access and opportunity. 

Nearly 1200 pages of petitions have recently been submitted to the Calif. F&G Commission, most of them attempting to severely limit your opportunity to "hunt coastal waters" in California. Just like protecting the mtn lion hunt in Colorado, we need to become informed, and rally to support angling opportunity when it is arbitrarily threatened.

10 Apr 2023INSIDE THE CAMPAIGN TO DIVORCE HUNTERS FROM WILDLIFE POLICY00:47:47

A nationwide campaign is underway to limit the influence of hunters in crafting wildlife policy. The movement has gained traction in recent years as proponents work to restructure state game commissions to be less responsive to the wishes of hunters.

“This movement has really spread throughout the country,” Joe Mullin told MeatEater. Mullin works for the Congressional Sportsmen’s Foundation as the Northeastern States Manager, and he reports that he’s observed “a more concerted, organized, and accelerated effort” to pass bills that remodel game commissions along less hunter-friendly lines.

Director of State Policy and Stewardship for Backcountry Hunters and Anglers, Tim Brass, has also been tracking this movement.

“Historically, sportsmen have had a big voice, and we’re concerned not only that we’re losing some of the voices we have had, but in some cases the people that they’re putting on the commissions under the ‘sportsman’s’ name are questionable in terms of their credentials as hunters and anglers,” he said in an interview with MeatEater.

Mullin identified efforts in Washington State, Maryland, Vermont, New Hampshire, Colorado, New Mexico, and Oregon that would make it easier to install anti-hunting proponents on the governing bodies meant to manage game species.

Wildlife for All, an environmental nonprofit, most clearly articulates the ideas that underwrite these efforts. Organized by current and former employees of the Humane Society, the Sierra Club, Wildearth Guardians, Animal & Earth Advocates, and Project Coyote (among others), Wildlife for All describes the current system of wildlife management as “outdated.”

“The hallmarks of this outdated system are a focus on producing a harvestable surplus of game animals under an agricultural model [and] preference given to consumptive wildlife users (hunters, anglers and trappers) over the broader public,” Wildlife for All says on its website. They seek to replace the current model with one based on the “public trust doctrine,” which they define as including a responsibility to protect “all life.”

If their efforts are successful, Mullin warns that the voices of hunters and anglers will be diminished. “If game commissions don’t have adequate representation from the outdoor sporting community, decisions will likely be made to the detriment of hunters, trappers, recreational shooters. There’d be no safeguards to prevent obstructionism at that point,” he said.

Overthrowing the North American Model of Wildlife Conservation

For over 80 years, hunters and anglers have formed the bedrock of the American system of conservation funding. This “user pays, public benefits” structure has allowed the North American Model of Wildlife Conservation to become the world’s most successful conservation framework, and hunters and anglers nationwide have contributed over $25.5 billion. This money has been used to save wetlands and bring species like turkeys and whitetail deer back from the brink of extinction.

State game commissions work with state wildlife agencies to manage a state’s natural resources, and many have statutory mandates to set hunting seasons, maximize hunting opportunities, and set bag limits. Game commissioners are appointed in a variety of ways, but many also require a certain level of representation from the hunting community. (Some, for example, require commissioners to hold hunting or fishing licenses for a certain number of years before being considered for the position.)

But recent legislation would seek to change that system. In Maryland, for example, House Bill 188 was endorsed by the Humane Society would require representatives from the “wildlife preservation” and “passive wildlife recreation communities” to serve on the state’s Wildlife Advisory Commission.

“This bill is giving a diverse set of stakeholders seats at the table on this commission,” bill sponsor Delegate Julie Palakovich Carr said.

In New Mexico, House Bill 486 takes the “public trust” language from Wildlife for All and uses it to rewrite state wildlife policy. Instead of providing for “an adequate and flexible system” to “provide and maintain an adequate supply of game and fish,” this new system would manage the state’s wildlife “as a public trust resource with intrinsic and ecological value, as well as for the benefit, use, food supply and nonconsumptive enjoyment of all.”

Wildlife for All praises a similarly worded New Mexico bill as an example of the kind of statutory changes the group would like to see in all states.

Washington State has become a lightning rod for this issue as some members of the Wildlife Commission seek to change the “overarching principles” that dictate how game is managed in the state.

Commissioner Lorna Smith recently introduced a draft outline for a new wildlife management plan that she says will radically change how game species are managed.

“It’s the overarching principles and background that we’re going to update significantly with things like my issues page. We’re not just putting a new cover on the old game management plan,” she said at a February 17 meeting of the Special Wildlife Committee.

The outline includes topics such as “Changing Faces, Changing Values, Changing Funding Support” and “Confounding Factors to Managing Hunting to ‘Optimal’ Levels.” Another point would classify coyotes and ground squirrels as managed species, though none of the commissioners argued that these species are in trouble.

“We need to look at species where now there are no regulations dealing with limitations on hunting or killing these species,” said commissioner Melanie Rowland. “I don’t know how you would define hunting differently. I think that’s something we should consider.”

These states aren’t alone. Georgia is considering a bill that some see as a Trojan horse for limiting the influence of hunters. Vermont considered a bill last year that would have stripped the Fish and Wildlife Board of its rulemaking authority and allowed a wider variety of entities to appoint members. A New Hampshire bill would have reduced the number of years a member of the fish and game commission was required to hold a resident fishing, hunting, or trapping license. Missouri, Nebraska, and Michigan have also introduced legislation in recent years intending to alter the composition and/or nomination process for commissions.

Many commissioners oppose these efforts, of course. Washington State commissioner Jim Anderson cautioned his colleagues about their plan to rewrite the game management document.

“I think the hunting public doesn’t want to see all the efforts that have gone on in the past cast aside as something that’s seen as new and better,” he said. “The way that is worded strikes me as being a negative way of talking about hunting.”

Sportsmen’s Alliance filed a lawsuit this week against Washington State commissioner Lorna Smith, but not directly for her actions while on the committee. They say Washington law prohibits someone from serving on the commission while holding another elected or appointed office (Smith is currently a member of the Jefferson County Planning Commission).

“We view this lawsuit as the initial step of a long but important process to bring sanity and decency back to wildlife decision-making in Washington," Todd Adkins, vice president of government affairs at the Sportsmen’s Alliance said. "It all starts here, but trust me, it won’t end here."

Changing the Composition of State Game Agencies

Certain hunting groups have voiced support for some aspects of this agenda. Hunters of Maryland, for example, joined with the Sierra Club to support HB 188. “Wildlife belongs to no one person, wildlife belongs to the citizenry,” said spokesman William R. Miles. “Diverse individuals, groups and organizations, who want a broader advisory voice in how Maryland’s DNR manages wildlife, is a good thing and should be afforded every opportunity.”

It’s also worth noting that “public trust” is a key tenet of the North American Model of Wildlife Conservation, and this doctrine has been used to guarantee hunters and anglers access to land, water, and wildlife. Many hunters, especially public land hunters, would agree that no one owns wildlife, including those who harvest animals for food.

It is unclear, however, whether Wildlife for All’s interpretation of the “public trust doctrine” aligns with its traditional meaning. Their desire to abolish wildlife commissions and represent “non-consumptive users” in proportion to their demographic in the general population is certainly out of step with how the public trust doctrine has traditionally been implemented.

Mullin also argues that efforts to change the composition of state game agencies will make it “easier for obstructionist behavior.” As hunters have seen in Washington State, it only takes a few commissioners to make proceedings grind to a halt.

“Rather than the commissions getting down to brass tacks, shaking up the composition would lower the door for anti-sportsmen to make their way in,” Mullin said.

Washington State commissioner Kim Thorburn expressed a similar concern in an interview with The Lewiston Tribune. “They don’t want to admit their decisions are based on their own advocacy biases,” she said of fellow commissioners Smith and Rowland, “so they have the tactic of paralyzing the staff effort, demanding impossible workloads of them and, when they come back (with products), saying, ‘That isn’t what we asked for.’”

Ultimately, both Brass and Mullin believe that anti-hunting groups see changing the makeup of game commissions as stepping stones toward their larger goals.

“The anti-hunting community is seeing these commissions as a vehicle to make changes in conjunction with legislative efforts and ballot initiatives. It’s another vessel that they see to carry out their objectives,” Mullin said.

More Than One Kind of Anti-Hunting

A state game commission can be politicized against hunters in more ways than one. Brass pointed out that commissions can harm hunters if they favor landowners or outfitters over public land users. He’s also concerned about national campaigns that seek to cut off Pittman-Robertson funding, which have been pushed from both the right side of the aisle and the left.

Wherever these threats may arise, it’s crucial for hunters, anglers, and all outdoor enthusiasts to stay engaged in the process, Brass said. He encouraged hunters to show up at commission meetings, be good spokespeople, and build relationships. Even if a commissioner doesn’t agree with hunters on most issues, it’s still important to engage.

“We need to show up at those commission meetings to make sure the sportsmen’s voice is still heard. We have the opportunity to hold them accountable by being there and helping to offer up good, well-reasoned arguments,” Brass said.

Hunters should use their voices to ensure their commissions make decisions based on science–not personal vendettas.

“In the end, if they’re not basing their decisions on science and the wildlife biologists’ recommendations and they’re attacking hunters because they just don’t like it, that is really problematic,” Brass said. “Representative or not, we can’t have that. We’re going down a pretty slippery slope.”

On a larger scale, hunters can do more to tell the full story of habitat and conservation funding, MeatEater’s Director of Conservation, Ryan Callaghan, said. Those stories can combat misinformation about hunters that some commissioners use to advocate for anti-hunting policies.

“It is our responsibility as hunters to promote the work we do,” Callaghan said. “Great whitetail habitat or sage grouse habitat or bear habitat is great habitat for a wide host of wildlife that falls under the ‘non-consumptive’ label. We hunters know that a tag in the pocket does not represent a dead animal. I have a pillowcase full of expensive tags that have never been notched. It's our responsibility to make sure people know those stories too.”

The Vermont legislature is in the midst of debating and deciding the fate of Senate Bill 258 (S. 258).  Through a well refined political strategy there is a coalition of anti-hunting interests who want to over-turn a proven and successful regulatory framework. S258 would strip rule-making capacity away from the Advisory Board, and give it to a Dept. which is headed up by political appointees. When there's a difference of opinion between the Advisory Board and the Dept., it would be reviewed by the legislature (more politics). Additionally, this legislation strips away the right to use hounds in pursuit of coyote, and eliminates baiting for coyote. There is nothing of value in this legislation, and where it has ambiguity you would be right to distrust the source and future outcomes. 

The anti-hunting industry is committed to upending the most effective regulatory systems in the US, where wildlife and ecosystems have thrived, and hunting opportunity has been prioritized. Non-hunters have benefitted from these systems, because we all want wildlife to succeed on the landscape. The anti-hunters are focused on stripping away human participation in nature - to the detriment of all stakeholders, including wildlife.
