Greetings to all you Barbies and Kens! In honor of the release of the much hyped Barbie movie, Tony and Evan decided to bring the “Kenergy” and devote episode 21 to all things Barbie! Mattel, the parent company that owns Barbie, has had their fair share of lawsuits involving Barbie, especially the use of the Barbie trademark. Evan and Tony lead things off with a lawsuit between Greiner & Hauser gMBH and Mattel (04:06) and how Mattel was originally accused of ripping off Barbie from a German doll called Bild Lilli. G&H and Mattel ended up settling but 50 years later, G&H gMBH pursued a lawsuit against Mattel, alleging their 1964 settlement agreement was no longer enforceable. Then, Tony and Evan talk about the iconic Mattel v. MCA Records case (14:55) and how a song called "Barbie Girl" was afforded protection under the First Amendment by way of the Rogers v. Grimaldi test. Tony and Evan then talk about Mattel's very brief trademark infringement lawsuit against Rap Snacks after the snack brand created a line of BBQ chips featuring Nicki Minaj but used the word "Barbie" in pink cursive on the front of the chip packaging (23:30). Finally, Evan and Tony share their favorite Barbie marketing collabs in connection with the new Barbie movie (31:43).

In this week's episode, Evan and Tony welcome 'The Queen of Christmas" Elizabeth Chan, a Billboard-charting Christmas singer-songwriter with hundreds of Christmas songs to her name! First, Tony, Evan, and Liz discuss an interesting copyright infringement lawsuit involving the Lord of the Rings prequel series on Amazon called "Rings of Power" and whether that case holds any weight (04:27). Later, Tony and Evan chat with Liz about what propelled her into the music profession (14:40) and what makes a good Christmas song (21:23). Liz chimes in on the trend of singers and songwriters selling their music library to third parties (24:36). Tony and Evan also ask Liz about her experience successfully defeating Mariah Carey in a 2022 trademark dispute over Carey's attempted trademark registration in the US Patent and Trademark Office for the word "Queen of Christmas" (27:13) and how important it was to pursue this opposition. Liz also weighs in on the legal concerns associated with the use of artificial intelligence in music (35:02). Finally, Liz, Tony, and Evan all share their favorite holiday traditions (37:44).

(Editor's note: shortly after Episode 12 was recorded, the jury in the Ed Sheeran copyright infringement lawsuit found Ed Sheeran NOT LIABLE for copyright infringement.) Later, Evan and Tony talk about the Apple TV+ series "Schmigadoon" and how it's legally possible for Cinco Paul and the writers of "Schmigadoon" to make the music for the show sound nearly identical to major Broadway musical numbers (17:37). Was the music in "Schmigadoon" created under fair use? Or was the underlying musical composition to major Broadway musical songs licensed by way of a mechanical license agreement? ¡Buenos dias, buenas tardes, y buenas noches a todos! Episode 6 presents a wave of interesting and breaking entertainment law stories! Tony and Evan kick it off with a breakdown of the lawsuit against Bad Bunny for violating the personality rights and moral rights of his ex-fiancé Carliz De La Cruz Hernandez (04:58). The lawsuit stems from a voice memo she made of her saying "Bad Bunny, Baby!" that has been featured as a "tag" at the start of two different Bad Bunny songs. The crazy part is...SHE NEVER GAVE PERMISSION TO USE THE VOICE MEMO IN THOSE SONGS! Later (17:10), Tony and Evan touch on a report from Variety (that his since been debunked) in which the Writers Guild of America was entertaining a proposal that would allow writers to use artificial intelligence software like Chat-GPT to create full scripts/screenplays and the writer would touch it up and still be named the principal writer. The problem though is that the US Copyright Office, and copyright law, in general, doesn't recognize AI-generated works as worthy of copyright protection. Tony and Evan then touch on Marvel Studios potentially pursuing legal action against the individual who leaked the script for the latest Ant-Man film on Reddit (24:51). Was it a leaker and are they subject to the rules of criminal copyright infringement? Or was this a Marvel Studios employee who leaked the script and is governed under an NDA? The fellas finish off today's episode by sharing their favorite movie theater snacks. After assigning copyright ownership over to MGM, David Lee Henry is seeking to terminate the assignment and have the copyright ownership reverted back to him as per the Copyright Act of 1976. Tony and Evan break down the legal implications and what the outcome could be. Next, Tony and Evan talk (and laugh) about an insanely horrible Willy Wonka location based experience that was created by a company in Glasgow, Scotland that was falsely advertised to be an amazing experience when it was far from one.
