U.S. law interprets consensual kink activities as harmful, criminal acts. This makes prosecuting sexual assault cases within the context of BDSM difficult. How can you prove non-consensual sex occurred if kink isn’t considered sex in the eyes of the law, it’s assault? The National Coalition for Sexual Freedom/NCSF worked along with the American Law Institute to establish a legal definition of consent in kink. They just unveiled the New Model Penal Code on Sexual Assault: Affirmative Defense of Explicit Prior Permission for use of force and restraint with sexual contact.

On ep 185 of American Sex Podcast, the NCSF’s Susan Wright & BebeBlueEyes explain how this gives legal power to sexual assault survivors, how it’ll be adopted state-by-state, about the new consent model EPP/Explicit Prior Permission & why implementing it as community standard is integral to changing case law, what you can do to help, how the NCSF can assist you with criminal sexual assault cases involving consensual kink, and more.

Guest Bio – Susan Wright, M.A

Susan Wright, M.A., (she/her) founded the National Coalition for Sexual Freedom in 1997, and currently serves as Executive Director. In addition, she serves on the advocacy and community advisory committees for AASECT, the APA’s Division 44: Task Force on Consensual Non-monogamy, Kink Clinician Guidelines, and the Diverse Sexualities Research Education Institute. She chaired the successful DSM-5 Revision Project which helped result in the consensual paraphilias being separated from the APA’s Paraphilic Disorders in 2013. She currently chairs the Consent Counts Committee that worked with the American Law Institute on the new Model Penal Code on Sexual Assault to create Section 213:10: Affirmative Defense of Explicit Prior Permission for use of force and restraint with sexual contact. Her research for NCSF focuses on discrimination and violence against alt-sex practitioners; consent practices and attitudes; and the mental and physical health of alt-sex practitioners, with papers published in journals including the International Journal of Environmental Research and Public Health, Psychology & Sexuality, Journal of Trauma and Dissociation, Journal of Interpersonal Violence, Archives of Sexual Behavior, Journal of Sexual Medicine, Journal of Behavioral Health Services & Research, Journal of Social and Clinical Psychology, International Journal of Social Psychiatry, and Journal of Homosexuality.

Oh, you lucky duckies! We launched this podcast with almost no fanfare, didn’t we? One day the American Sex podcast didn’t exist and the next day it’s like someone quietly slipped it under your pillow. Like a surprise gift  . . . from a secret admirer . . . or the NSFW tooth fairy! Don’t worry though, we won’t steal your teeth.  

Ken and I have been working on American Sex for a while. A few episodes are already recorded and in various states of editing and we’re pounding more out behind the scenes as quickly as we can (oh yeah we are, *wink*).   

But we’re the types that can’t hold on to presents. You know when it’s the day before someone’s birthday and you got them the greatest present ever? And you’re so excited to give it to them that you’re going to explode? So then you just start bugging them, “hey, you want your present? You want it early? I won’t mind! You know you do! You want it early don’t you?! Can I give it to you? PLUEEESSSEE!!?!?” That’s us. It's your birthday tomorrow. AND WE WANT TO GIVE YOU YOUR PRESENT NOW!

So here’s Episode 1 of American Sex. Think of like how they release a pilot to a new show and then they make you wait a bit for the rest of the episodes. But with us it’s not even that bad-- here’s the deal: We’ll be back in two weeks with regular weekly episodes from that point on.

Veronika Kestrel (She/Her) is a Professional Dominatrix and kink lifestyle educator affiliated with the Los Angeles Sanctuary. A 15-year veteran of the kink lifestyle, she began her kink journey in the Denver community and relocated to Southern California in 2018, where she helped facilitate trans-focused events in the Orange County scene. Since then, she has conducted clinics for the LA Sanctuary, CancerPhase Productions, and at numerous private venues. She was a panelist at DomCon 2022, and has appeared on "Your Kinky Friends", "Pink Kink Podcast", and, of course, "American Sex Podcast"! She prides herself in her efforts to make Kink a friendlier, more ethical, and inclusive community in any way she can. Dr. Joycelyn Elders was the 2nd woman and 1st African American person appointed Surgeon General of the United States. She’s also a sexual health revolutionary. In 1994 President Clinton forced Elders to resign after she advised masturbation be recommended in sex ed programs as an alternative to sex to curtail the spread of HIV. Ken & Sunny talk with Dr. Elders about sexual health, pleasure inclusive sex ed in church, transgender children, the legalization of marijuana, Waffle House vs. Denny's, #MeToo & more. Ken & Sunny also celebrate the second season of Netflix’s Stranger Things with their corny parody, Weirder Occurrences.

Guest bio  Dr. M. Joycelyn Elders was the 16th United States Surgeon General. She was the First African American & second woman to ever hold the position. Dr. Elders grew up in rural segregated Arkansas and was the daughter of a sharecropper. After graduating high school she earned a university scholarship and found her calling was in medicine. Elders became a well respected pediatric endocrinologist. This is where her passion for comprehensive sex education took root. Pregnancy was dangerous for teenage girls with diabetes and other illnesses and elders recognized the need to give these young women clear useable information on pregnancy prevention and sexuality education. She taught these young women not be ashamed of their sexual feelings but instead have agency over their own bodies and to approach their own sexuality with intelligence and responsibility.  

In 1986 Elders was named Director of the Arkansas Department of Health. She fought with conservative and religious opponents and opened clinics in schools, she made condoms and comprehensive sex education available to children and teens. In 1993 she was appointed surgeon general of the United States under President Bill Clinton. After 15 months she was forced to resign when she made an unforgettable remark to the press. When asked if the spread of AIDS could be reduced through advocating masturbation as an alternative to sexual intercourse, Dr. Elders answered:


“I think that is something that is a part of human sexuality and it’s a part of something that perhaps should be taught.”


Already controversial for speaking up about comprehensive sex ed, birth control, and supporting the legalization of marijuana, this was too much. President Clinton forced her to resign. Elders went back to medicine and teaching and has since retired. She is still, however, very vocal about the importance of sexuality education.
